Fine up to VND 20 million for age discrimination in recruitment and training between men and women

This is one of the notable contents of Decree 55/2009/ND-CP stipulating penalties for administrative violations regarding gender equality.

According to this Decree, a fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for acts specifying different training ages or admission ages between men and women. Specifically, Clause 3 Article 9 of this Decree stipulates the penalty levels for administrative violations on gender equality in the field of education and training as follows:

3. A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for any of the following acts :

a) Specifying different training ages or admission ages between men and women ;

b) Organizing vocational education, compiling, disseminating textbooks, teaching materials, and teaching programs containing gender prejudices .

Therefore, acts discriminating admission ages or training ages between men and women will be fined up to VND 20,000,000. Additionally, remedial measures include the requirement to amend, abolish, or recommend competent authorities to abolish regulations on training ages and admission ages with gender prejudices and discrimination.

Moreover, this Decree also stipulates that a warning or a fine ranging from VND 200,000 to VND 500,000 shall be imposed for acts of encouraging or forcing others to quit school due to gender reasons.

For acts of encouraging or forcing multiple people to quit school due to gender reasons or refusing admission to qualified candidates for training courses due to gender reasons, pregnancy, childbirth, or childcare, a fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed.

Article 9. Acts of administrative violations on gender equality in the field of education and training

1. A warning or a fine ranging from VND 200,000 to VND 500,000 shall be imposed for acts of encouraging or forcing others to quit school due to gender reasons .

2. A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts :

a) Encouraging or forcing multiple people to quit school due to gender reasons ;

b) Refusing admission to qualified candidates for training courses due to gender reasons, pregnancy, childbirth, or childcare .
