Cover hot song posted to TikTok is an adventure of young people nowadays in Vietnam. However, covering someone else's song without permission has some legal consequences that need to be taken care of.

Currently, the cover of other people's songs posted to TikTok without permission, not paying pen profit, remuneration can be administratively sanctioned up to VND 30 million in Vietnam.
According to Clause 6 , Article 1 of the Law on Intellectual Property amended and supplemented in 2009 and Article 13 of Decree 131/2013/ND-CP on infringement of the right to perform works in public, the following shall be specifically sanctioned:
- A fine of between VND 5,000,000 and VND 10,000,000 shall be imposed for the act of performing the work in public without the permission of the owner of the copyright in Vietnam as prescribed.
- A fine of between VND 10,000,000 and VND 15,000,000 shall be imposed for acts of performing works through audio or video recording programs or any technical means accessible to the public without the permission of the owner of the copyright as prescribed.
However, the above is only an administrative sanction for individuals in Vietnam.
If the organization commits similar violations, it will be double sanctioned (maximum penalty up to VND 30 million)
In addition, remedial measures are also applied: compulsory removal of copies of audio and video recordings of violations against organizations and individuals that infringe upon human rights in Vietnam.
From the above regulation, it can be seen that the cover of other people's songs posted on social networks such as TikTok without permission, not paying pen profit, remuneration is a violation of the law can be sanctioned up to VND 30 million in Vietnam. The State shall consider, depending on the nature and severity of the violations, the application of sanctions.
