Additional prohibited acts concerning Citizen Identity in Vietnam (Proposal)
According to the draft amended Law on Citizen Identity, prohibited acts include:
- Issuing, changing, or re-granting citizen identification cards in contravention of law.
- Harassing, causing trouble when handling procedures for citizen identification, the National Population Database, and the Identity Database.
- Falsifying books and records on citizens, the National Population Database, and the Identity Database; failing to provide, providing incompletely, or illegally providing information and documents on citizen identification, the National Population Database, and the Identity Database; abusing information about citizens according to the provisions of this Law, causing damage to agencies, organizations, and individuals.
- Collecting and using fees and charges in contravention of the law.
- Forging, modifying, or falsifying the contents of citizen identification cards; appropriating and illegally using other people's citizen identification cards; renting, leasing, borrowing, lending, pledging, and destroying citizen identification cards; using fake citizenship cards.
- Illegally accessing, altering, deleting, destroying, distributing, or performing other activities related to the processing of personal data in the National Population Database and the Identity Database contrary to the provisions of this law and other relevant laws.
- Revocation and temporary seizure of citizen identification cards contrary to law.
- Illegally buying, selling, exchanging, sharing, appropriating, and using information and data in the National Population Database and the Identity Database.
In general, the basic prohibited acts are kept as prescribed by the current Law on Citizenship Identification;
However, including corrections and additions of content that are prohibited from buying, selling, exchanging, sharing, appropriating, and illegally using information and data in the National Population Database and the Identity Database in accordance with the orientation of citizen identity management in the draft Law.
Citizens' rights and obligations regarding citizen identity in Vietnam
According to the draft Law, the rights and obligations of citizens regarding citizen identity, the National Population Database, and the National Identity Database in Vietnam are as follows:
1. Citizens have the following rights:
- Being guaranteed personal and family secrets in the National Population Database and the Identity Database, except for providing information and documents as required by law;
- Requesting the identity management agency to update and correct information when information in the National Population Database, the National Identity Database, or the citizen's identity card is not available, inaccurate, or has been changed according to the provisions of law;
- Being granted, changed, or re-issued citizen identification cards in accordance with this Law;
- Using their citizen identification cards in transactions and exercising citizens' legitimate rights and interests;
- Complaints, denunciations, and lawsuits according to the provisions of law for violations of the law on citizen identification, the National Population Database, and the Identity Database.
2. Citizens have the following obligations:
- Complying with the provisions of this Law and relevant laws;
- Carrying out procedures for the grant, change, and re-issue of citizen identification cards in accordance with this Law;
- Providing fully, accurately, and on time their own information and documents to update into the National Database on Population and the Identity Database in accordance with this Law and relevant laws;
- Presenting the citizen's identity card when the competent person requests the inspection according to the provisions of law;
- Preserving and preserving the issued citizen identification cards; upon loss, it must promptly report it to the identity management agency;
- Returning the citizen identification card to the competent authority in case of change, withdrawal or temporary seizure of the card according to the provisions of this Law.
3. A person suffering from a mental illness or another disease that causes him or her to lose the ability to perceive or control his/her behavior through his/her lawful representative shall exercise his/her prescribed rights and obligations.
