1. What is the National border?

According to Article 1 of the Law on National Borders 2003, the National border of the Socialist Republic of Vietnam refers to vertical lines and planes determined by such lines which are based on to determine boundary of land territory, island and archipelago territories, including Hoang Sa and Truong Sa archipelagoes, territorial waters, underground and airspace of the Socialist Republic of Vietnam.

2. 07 measures to manage and protect national borders in Vietnam

Measures to manage and protect national borders under Clause 1, Article 20 of the Law on Border Protection of Vietnam 2020 include:

(1) Mass mobilization;

(2) Law;

(3) Diplomacy;

(4) Economy;

(5) Science and engineering;

(6) Profession;

(7) Armed.

3. Forms of management and protection of national borders in Vietnam

Forms of management and protection of national borders according to Clauses 1 and 2, Article 19 of the Law on Border Protection of Vietnam 2020, are as follows:

Forms of management and protection of national borders include:

+ Border management and protection are regularly applied in cases where the situation of sovereignty, territory, security, social order, and safety in border areas is stable;

+ When significant political, economic, cultural, and social events occur in border areas, at border gates, and on both sides of the border, enhanced border management and protection must be implemented; the situation of security, social order, and safety in a number of border areas is complicated;

Peripheral areas and border areas are conducting military drills, security and order, natural disasters, epidemics, rescue and rescue, or conducting activities to arrest criminals where the offenders may cross the border, at the request of the border management and protection force of the country sharing the border;

Management and protection of borders in a state of national defense emergency, martial law, curfew, or a state of war shall comply with the provisions of the law on national defense.

- The following authorities have the authority to change the form of national border management and protection:

+ If the Commander of the Border Guard decides to change the form of border management and protection specified in Points a and b, Clause 1, Article 19 of the Law on Border Protection of Vietnam 2020, he or she must immediately notify the Ministry of National Defense of Vietnam and accept legal responsibility for their decisions, which include:

++ Border management and protection are regularly applied in cases where the situation of sovereignty, territory, security, social order, and safety in border areas is stable;

++ Enhanced border management and protection shall be applied when important political, economic, cultural, and social events take place in border areas, at border gates, or on both sides of the border; the situation of security, social order, and safety in a number of areas in the border areas is complicated;

Peripheral areas and border areas are conducting military drills, security and order, natural disasters, epidemics, rescue and rescue, or conducting activities to arrest criminals where the offenders may cross the border, at the request of the border management and protection force of the country sharing the border;

+ The Minister of National Defense may change the form of border management and protection specified in Point c, Clause 1, Article 19 of the Law on Border Protection of Vietnam 2020:

Management and protection of borders in a state of national defense emergency, martial law, curfew, or a state of war shall comply with the provisions of the law on national defense.
