07 Locations not eligible for new permanent/temporary residence registration in Vietnam from July 1/2021

Law on Residence 2020 which officially takes effect from July 1, 2021 , stipulates the removal of household registration books and temporary residence books as well as locations not eligible for new permanent/temporary residence registration in Vietnam.

07 Locations not eligible for new permanent/temporary residence registration in Vietnam from July 1/2021

Specifically, according to the provisions of the Residence Law 2020, from July 1, 2021, when the Residence Law 2020 officially takes effect, the management of residences by manual methods using physical means will be completely replaced by modern management methods using information technology.

When people carry out procedures for permanent residence or temporary residence registration, the registration authority shall appraise and update information on the households related to the new permanent or temporary residence in the residence database instead of issuing household registration books and temporary residence books as previously prescribed.

At the same time, according to Articles 23 and clause 3, Article 27 of the Law on Residence 2020, people are not allowed to register for a school or register for a new temporary residence at the following locations:

(1) Places of residence situated in locations or areas forbidden from construction or encroaching protection corridors for national defense and security, transport, irrigation, dikes and energy, protection markers for technical infrastructure works and ranked historical - cultural sites, areas at risk of landslides, flash floods and pipe floods, and protection areas for other works as prescribed by law in Vietnam.

(2) Places of residence the whole floor area of which are located on illegally encroached land or places of residence located on land not eligible for construction as per the law in Vietnam.

(3) Places of residence issued with a decision on land use right revocation and decision approving plan for compensation, assistance and relocation by the competent authority in Vietnam;

(4) Places of residence being houses the whole or a part of floor area of which is subject to a dispute or complaint related to ownership or right of use unresolved as per the law in Vietnam.

(5) Places of residence confiscated as decided by the competent authority in Vietnam;

(6) Vehicles which are registered as permanent residences but the vehicle registration of which has been annulled or which do not possess the inspection certificate for compliance with technical safety and environmental protection requirements as per the law in Vietnam.

(7) Places of residence being houses issued with a demolition decision by the competent authority in Vietnam.

Particularly in the cases of a wife moving in with her husband, a husband moving in with his wife, and children moving in with their parents; if parents move in with their children, they can apply for new permanent residence registration at these locations.
