07 Instances Where Signature Certification is Not Permitted From 2020

This is one of the notable contents stipulated in the Draft Circular detailing and guiding the implementation of several provisions of Decree 23/2015/ND-CP, replacing Circular 20/2015/TT-BTP.

To be specific, according to the proposal in this Draft, in addition to the 04 cases where signature authentication is not permitted as stipulated in Article 25 of Decree 23/2015/ND-CP, the following 03 additional cases will not be permitted for signature authentication:

- Documents with content related to papers issued according to legal regulations.

Examples*:*- Self-declared documents or commitments related to civil status events such as birth registration, death registration, marriage, recognition of parentage;- Commitment documents, confirmations related to business registration industries, degrees, certificates, health certifications, criminal records…

- Authorization letters related to the sale, transfer, lease, establishment of ownership, usage rights for real estate in Vietnam.

- Authorization letters related to complaints, denunciations.

Thus, if this content in the Draft is approved, from 2020 there will be 07 cases where signature authentication is not permitted.

The 04 previously stipulated cases in Decree 23/2015/ND-CP include:

- At the time of authentication, the person requesting signature authentication is not aware and not in control of their actions.

- The person requesting signature authentication presents an expired or fake Identity Card or Passport.

- Documents with content that violate laws or social ethics; propaganda, incitement to war, against the socialist policies of Vietnam; distorting Vietnam's history; offending the honor, dignity, reputation of individuals or organizations; violating civil rights.

- Documents with content that are contracts or transactions, except for signature authentication in authorization letters where the authorization has no remuneration, no compensation obligation of the authorized party, and does not relate to the transfer of ownership of assets, real estate usage rights or other cases provided by law.
