Summary of 05 Important Newly Issued Policies on Customs

In order to help our members stay updated with the latest policies, Thu Ky Luat will highlight 05 important documents related to the customs field that have just been issued, including:

1. Decision 24/2018/QD-TTg: List of Electrical Equipment Prohibited from Import

Effective from July 10, 2018, certain electrical equipment will not be allowed to be imported into Vietnam unless they meet the standards specified in Appendix I attached to Decision 24/2018/QD-TTg, such as:

- Household appliances like: Compact fluorescent lamps (TCVN 7896:2008); Electric fans (TCVN 7826:2007); Refrigerators, freezers (TCVN 7828:2013); Rice cookers (TCVN 8252:2008); Washing machines (TCVN 8526:2010);- Office and commercial equipment like: Photocopiers (TCVN 9510:2012); Printers (TCVN: 9509:2012); Computer monitors (TCVN 9508:2012);- Industrial equipment like: Boilers in industrial enterprises (TCVN 8630:2010).

Additionally, Decision 24/2018/QD-TTg includes Appendix II listing equipment prohibited from import starting from July 10, 2020.

Detailed list of equipment prohibited from import can be found in Decision 24/2018/QD-TTg effective from July 10, 2018.

2. Circular 14/2018/TT-BYT: HS Code List for Medical Equipment Applicable from July 1, 2018.

Circular 14/2018/TT-BYT on issuing the list of medical equipment identified with commodities codes according to the export and import commodity list of Vietnam.

It supplements many medical equipment identified with commodity codes, such as:

- Metal syringes, surgical needles; metal surgical needles; blood and body fluid collection needles and pens; needles used with dialysis systems; intravenous catheters (9018.32.00);- Ophthalmic instruments and appliances (9018.50.00);- Hearing aids, excluding parts and accessories (9021.40.00);- Computerized tomography (CT) scanners (9022.12.00);- …

The identified commodity codes list of medical equipment serves as a basis for individuals and organizations to declare customs when exporting or importing medical equipment into Vietnam.

Circular 14/2018/TT-BYT is effective from July 1, 2018, replacing Appendix I in Circular 30/2015/TT-BYT.

3. Decree 69/2018/ND-CP: Detailed Guidance on Temporary Import - Re-export, Temporary Export - Re-import

On May 15, 2018, the Government of Vietnam issued Decree 69/2018/ND-CP guiding certain provisions of the 2017 Foreign Trade Management Law.

Significantly, it provides detailed regulations on cases of temporary import for re-export, specifically:

- For goods temporarily imported that are not yet allowed to be circulated or used in Vietnam, goods regulated by import-export quotas, tariff quotas, a temporary import-re-export permit from the Ministry of Industry and Trade is required. For other cases, only the procedures for temporary import and re-export need to be completed without requiring a temporary import-re-export permit;- Goods for temporary import business must remain in Vietnam for no more than 60 days from the date of completing temporary import customs procedures. Extension at the customs sub-department is allowed up to 30 days each time and not more than twice for each batch of temporarily imported, re-exported goods.

4. Decree 74/2018/ND-CP: Conformity Announcement for Imported Group-2 Goods

State quality inspection for potentially unsafe goods (group-2 goods) is carried out by reviewing the conformity announcement activities of the importer.

The conformity announcement is detailed in the respective national technical regulations through one of the following measures:

- Self-assessment results of conformity by the organization or individual;- Certification and inspection results from a registered or recognized certification, inspection organization according to the law;- Certification and inspection results from a designated certification, inspection organization according to the law.

5. Circular 06/2018/TT-BYT: HS Code Identification of Cosmetic Goods

Circular 06/2018/TT-BYT on issuing the list of drugs, drug materials for human use, and cosmetics for export and import identified with commodity codes according to the export and import commodity list of Vietnam.

From May 21, 2018, the HS code application for exported and imported cosmetic goods will be implemented according to Circular 06/2018/TT-BYT, replacing the commodity list in Circular 45/2016/TT-BYT.

The cosmetic goods identified with HS codes in Circular 16/2018/TT-BYT include: Perfumes, scents; makeup powder; bath soaps; hair removal products; hair care products; makeup products; sunscreen products…
