Prominent Customs Policies Effective from June 2018

Starting from June, multiple new policies regarding import and export will officially come into effect. To assist esteemed members in updating promptly, Thu Ky Luat respectfully introduces the following 04 new policies:

1. Issuing New Forms for Reporting with Transit, Entry, and Exit Transport Vehicles

Circular 50/2018/TT-BTC issues the information criteria and reporting document forms when carrying out the exit, entry, and transit procedures for transport vehicles at air, sea, rail, road, and river border checkpoints as prescribed in Decree 59/2018/ND-CP.

For vehicles exiting, entering, and transiting through sea border checkpoints, the information criteria guiding the implementation of the report include:

- General Declaration;- Cargo Declaration for Sea Export and Import;- Master Bill of Lading; Secondary Bill of Lading;- Crew Member List; Passenger List;- Crew Baggage Declaration;- Dangerous Goods Declaration;- Ship's Stores Declaration;- Document Transfer Sheet for Ship Shifting Port.

2. Applying New HS Codes for Insecticidal and Bactericidal Products from June 12, 2018

Circular 09/2018/TT-BYT updates the product codes for 16 groups of insecticidal and bactericidal products such as coils, impregnated plates, evaporative solutions, insect repellent sprays, etc.

In cases where the goods are specified in the list but do not have an assigned product code, when importing, businesses must provide the customs authority with complete information about the imported goods regarding composition, effects, technical documentation (if any), and commit to being responsible for the declared content and using the imported goods for the correct purpose.

Detailed HS codes for goods can be found in Circular 09/2018/TT-BYT effective from June 12, 2018, replacing Circular 12/2016/TT-BYT.

3. Enterprises Allowed to Participate in Auctions for Confiscated Smuggled Foreign Cigarettes for Export

Confiscated smuggled foreign cigarettes that meet quality standards are auctioned off for export abroad. The winning enterprise must complete export procedures to remove the goods from the territory of Vietnam within 90 days from the auction winning date.

This content is based on Decision 20/2018/QD-TTg effective from June 15, 2018, and expiring on June 15, 2020.

4. Changing Multiple Customs Procedures per Decree 59/2018/ND-CP

Decree 59/2018/ND-CP, effective from June 5, 2018, amends various important customs procedures such as customs clearance locations, customs declarants, methods for determining customs value, import permits, customs procedures for temporarily imported – re-exported goods, etc.

Notably, it requires an Export or Import Permit before registering the customs declaration. Specifically, for export-import goods that require a permit from a specialized agency, the permit must be obtained before registering the customs declaration, and complete information must be declared on the customs declaration form.
