The dossier and order of procedures for importing used technological lines by a simplified method are specified in Clause 1 and Article 1 of Decision 28/2022/QD-TTg as follows:

1. Documents of the import of used technological lines by a simplified method in Vietnam

In addition to the import dossier as prescribed by the Customs Law, when carrying out procedures for importing the first batch of goods belonging to the technological line, the enterprise in Vietnam must supplement the following documents:

Copy of one of the following documents:

+ High-tech enterprise certificate;

+ Ministry of Science and Technology certificate of high-tech application activities;

+ Investment Registration Certificate;

+ Approval of the investment policy decision;

+ Written agreement with a competent state agency stating that the project is eligible for special investment incentives;

- The written commitment of the enterprise is enclosed with a list of used machinery and equipment in the technological line expected to be imported, prepared in accordance with Form No. 01;

- A written registration for the assessment of the technological line after it has been imported, installed, completed, and put into operation; certified by the designated inspection organization; and accompanied by a list of used machinery and equipment in the technological line expected to be imported, as specified in Form No. 2.

The enterprise shall send a written request for adjustment of the list of imported machinery and equipment, certified by a designated inspection organization, to the Ministry of Science and Technology and the customs office where the import procedures are carried out.

2. Procedures for importing used technological lines in a simplified manner in Vietnam

- Enterprises are allowed to bring their goods back for preservation according to the provisions of the customs law after submitting the import dossiers and documents in item (1) to the customs authority. Enterprises are only allowed to carry out import procedures for consignments of used technology lines at a customs clearance location.

- Within 12 months from the date of bringing the first shipment of the technological line into preservation, according to the provisions of the customs law, the enterprise must submit the inspection certificate to the customs authority.

Customs authorities only carry out customs clearance procedures as prescribed when the import dossiers and documents are complete and valid and the inspection certificate concludes that the used technological line meets the prescribed criteria. During the time of putting goods into storage, according to the provisions of the customs law, enterprises are only allowed to install and operate technological lines to serve inspection activities, not to put these lines into production.

In case the technological line has high complexity and the time required for installation, operation, and inspection of the technological line exceeds the committed time, at least 30 days before the deadline for submitting the assessment certificate, the enterprise shall send a written request for extension of the time limit for submission of the assessment certificate certified by a designated assessment organization according to Form No. 03 to the Ministry of Science and Technology and the customs office where the import procedures are carried out. The extension is only done once, and the extension time for submitting the assessment certificate must not exceed 6 months compared to the time when the enterprise made the first commitment.

If the results of the assessment of technological lines do not meet the requirements as prescribed, the enterprise will be handled according to regulations on sanctioning administrative violations in the field of customs and forced to re-export.

- Within five working days after completing customs clearance procedures or being refused clearance, enterprises send reports to the Ministry of Science and Technology and the People's Committees of the provinces and centrally-run cities where the project is implemented using Form No. 04.
