When are Vietnam Traffic Police exempted from saluting offenders?

According to Circular 65/2020/TT-BCA, when conducting the control of vehicles and drivers participating in traffic, traffic police must perform a salute according to the regulations of the Vietnam People's Public Security Force or salute verbally. According to Article 18 of Circular 65/2020/TT-BCA, when the vehicle that needs to be inspected has stopped at the correct position as guided, the traffic police officer assigned to the inspection task shall stand at an appropriate, safe position and proceed as follows:

- Notify and request the vehicle operator to take safety measures, disembark the vehicle, and present the relevant documents as prescribed;

- Perform the salute gesture according to the People's Public Security Ordinance or greet verbally: “Hello sir, madam, brother, sister…” (except in case of prior knowledge that the person is committing a criminal act, caught in the act, under a wanted notice), then say: “Requesting sir, madam, brother, sister... to allow us to inspect the relevant documents and the vehicle”;

- Upon receiving the documents (if any), inform the vehicle operator and the passengers of the reason for the inspection, then proceed with the inspection as per the provisions of Clause 2, Article 10 of this Circular;

- After completing the inspection, the traffic police officer reports the result to the team leader, informs the vehicle operator and the passengers of the inspection results, any violations (if any), and measures of handling, and say: “Thank you sir, madam, brother, sister… for cooperating with the traffic police force to ensure traffic order and safety”. For vehicles carrying 10 or more passengers, the officer will directly inspect the passenger compartment and inform the inspection results;

- When there is a basis to believe that the persons, vehicles, or objects contain evidence, means, or documents used for administrative violations, the traffic police officer has the right to search the persons, vehicles, or objects as per the law on handling administrative violations;

- In case of detecting signs of a crime, follow the provisions of the criminal procedure law.

Thus, according to the above regulations, traffic police must notify and request the vehicle operator (car, motorbike, electric bike, etc.) to take safety measures, disembark the vehicle, and present the relevant documents as prescribed. Simultaneously, they must perform the salute gesture according to the People's Public Security Ordinance or greet verbally: “Hello sir, madam, brother, sister…”, then say: “Requesting sir, madam, brother, sister... to allow us to inspect the relevant documents and the vehicle”.... However, in special circumstances, traffic police are exempted from saluting offenders. These circumstances include:

- Prior knowledge that the person is committing a criminal act;

- Caught in the act of committing a crime;

- Under a wanted notice.

Additionally, after completing the inspection, the traffic police officer reports the result to the team leader, informs the vehicle operator and passengers of the inspection results, any violations (if any), measures of handling, and says: “Thank you sir, madam, brother, sister… for cooperating with the traffic police force to ensure traffic order and safety.” For vehicles carrying 10 or more passengers, the officer will directly inspect the passenger compartment and inform the inspection results.

It can be seen that the gesture of saluting offenders when controlling road traffic is necessary to build the image of a People's Public Security officer who is brave, humane, serving the people. It also equips each officer with a manual of polite behavior as members of the Traffic Police force. The goal is to respect and serve the people, gaining their trust as a priority. However, traffic police are not required to salute individuals committing acts harmful to the public or societal order.
