Vietnam: Guidelines for transferring old motorbikes in the same province or in different provinces

In order to assist Customers and Members to understand the procedure for transferring old motorbikes in accordance with Vietnam’s regulations to avoid fines, LAWNET would like to guide the procedure for transferring old motorbikes in the same province or different provinces in the article below.

* Transferring old motorbikes in the same central-affiliated provinces or cities

Step 1: Submit vehicle registration certificate, license plate 

According to Point b Clause 3 Article 6 of the Circular No. 58/2020/TT-BCA of the Ministry of Public Security of Vietnam on procedures for issuance and revocation of vehicle registration and license plates of road motor vehicles, within 7 days, from the date of documenting the vehicle title transfer from an entity, the vehicle owner shall, in person or authorize another entity to, submit an application form for vehicle registration to the competent vehicle registry.

Note: If the entity as a buyer, receiver or heir of that vehicle carries out the procedures for vehicle title transfer immediately, the revocation of the vehicle registration certificate is not required.

Step 2: Prepare title transfer documentation

According to Article 19 of the Circular No. 58/2020/TT-BCA of the Ministry of Public Security of Vietnam, the transferee of vehicle ownership is responsible for preparing 01 set of documents including:

- The declaration of vehicle registration (form 01);

- A proof of vehicle registration fee according to statutory regulations:

+ A receipt or a written proof of payment to the state budget or payment order through the bank of vehicle registration fee or other documentation on payment of vehicle registration fee as per the law or document printed from the vehicle registration system (with all information about the make, model number, model, engine number, chassis number). If there is only one proof of payment for vehicle registration fee, each vehicle must submit a proper duplicate legally certified and confirmed by an agency where that proof has been issued;

+ As for vehicles exempted from paying the registration fee: the declaration of registration fee certified by the tax authority.

- The documentation of vehicle title transfer:

 

+ Invoices, financial documents (receipts) or documentation on sale and gifting of vehicle (decision, contract, inheritance document) as per the law;

+ Written agreement on sale or gifting of vehicle between individuals must be authenticated or notarized, or certified by the employers with respect to the armed forces; and foreign nationals working for diplomatic missions, consular posts and representative offices of international organizations, and registers his/her vehicle at the address of his/her employer, he/she must provide the confirmation from them;

+ As for liquidated vehicles of police: A decision on liquidation of vehicle made by the competent authority and invoice of selling public property or selling state-owned property;

+ As for liquidated vehicles of the military: A certificate of vehicle registration, an official dispatch certifying that the vehicle has been moved out of the military equipment of the Department of Vehicles affiliated to the Ministry of National Defense and an invoice of selling public property or selling state-owned property.

Concurrently, the transferee must present the vehicle owner's papers (ID card, citizen ID card, household registration book etc.) to complete the registration procedures for title transfer.

Step 3: Submit title transfer documentation 

The transferee of vehicle ownership transfer shall submit 01 application for registration of vehicle title transfer to the police office of the district, town or provincial city where he/she resides for processing of the vehicle title transfer according to its competence.

Step 4: Receive the vehicle registration certificate

Competent police agencies shall examine, complete dossiers and issue the vehicle registration certificate according to regulations.

* Transferring old motorbikes in different central-affiliated provinces or cities

Step 1: Declare and submit vehicle registration certificate, license plate

According to Point b Clause 3 Article 6 of the Circular No. 58/2020/TT-BCA of the Ministry of Public Security of Vietnam, within 7 days, from the date of documenting the vehicle title transfer from an entity, the vehicle owner shall, in person or authorize another entity to, submit an application form for vehicle registration and the license plate to the competent vehicle registry.

The officer in charge of vehicle registration shall revoke vehicle registration and license plate on the vehicle registration system, issue the certificate of revocation of vehicle registration and issue the temporary license plate.

Step 2: Prepare title transfer documentation

According to Article 19 of the Circular No. 58/2020/TT-BCA of the Ministry of Public Security of Vietnam, the transferee of vehicle ownership is responsible for preparing 01 set of documents including:

- The declaration of vehicle registration (form 01);

- A proven documentation of the title transfer;

- A proof of vehicle registration fee;

- The certificate of revocation of vehicle registration and license plate.

Concurrently, the transferee must present the vehicle owner's papers (ID card, citizen ID card, household registration book etc.) to complete the registration procedures for title transfer.

Step 3: Submit title transfer documentation 

The transferee of vehicle ownership transfer shall submit 01 application for registration of vehicle title transfer to the police office of the district, town or provincial city where he/she resides for processing of the vehicle title transfer according to its competence.

Step 4: Bấm chọn biển số và nhận Giấy chứng nhận đăng ký xe

According to Article 10 of the Circular No. 58/2020/TT-BCA of the Ministry of Public Security of Vietnam, the transferee of vehicle ownership transfer selects the license plate on the vehicle registration system according to the instructions and receives an appointment to return the vehicle registration certificate, pay the vehicle registration fee and receive the license plate.

Note: According to Article 5 of Circular No. 229/2016/TT-BTC, the fee for the renewal of registration papers with number plates for motorbikes is VND 50,000/time/vehicle.
