Vietnam: Driver's license revoked by traffic police: Can the driver give up to take a new license test?

When the traffic police take away the driver's license, can the violator give up that license to take a new driver's license?

The revocation of driving certificate (driving license) is considered as the definite deprivation of the right to use licenses, which is a form of sanction applied to individuals and organizations that seriously violate traffic activities. During the period of being deprived of the right to use the license, individuals and organizations are not allowed to carry out the activities stated in the license, namely driving (Clause 1 Article 25 of the Law on handling administrative violations 2012 of Vietnam).

Can the violator give up the revoked license and take a new license test?

In principle, if the driver's license is revoked for a period of time, it means that the violator is not allowed to drive the same vehicles during that period of deprivation. Therefore, until the expiration of the fine period, this person is not allowed to study, take the test and issue a new driving license.

Pursuant to Point g Clause 3 Article 37 of the Decree No. 100/2019/NĐ-CP of Vietnam Government, the individual that provides false information or fraudulent documents to be allowed to learn, take the test and to be granted the driving license or certificate of training in traffic rules shall be fined ranging from VND 3,000,000 to VND 5,000,000. In addition, forged papers and documents will be confiscated.
