The content is stated in the Draft Dossier (including the Proposal, Decision of the Prime Minister) submitted to the government by the Ministry of Transport, outlining the roadmap for establishing emission standards applicable to motorcycles and mopeds circulating in the period 2018-2020 for motorcycles with engine displacement of 175 cm3 and above.
Issued in conjunction with this Draft Dossier are:
- Draft Decision of the Prime Minister of the Government of Vietnam regarding the roadmap for applying emission standards to motorcycles participating in traffic (Hereafter referred to as the Draft Decision).- Draft Proposal on the issuance of the Prime Minister's Decision of the Government of Vietnam on the Roadmap for applying emission standards to motorcycles participating in traffic. (Hereafter referred to as the Draft Proposal).
According to the roadmap stipulated in the Draft Decision of the Prime Minister, from July 1, 2018, motorcycles with a cylinder capacity of 175 cm3 or more must meet emission standards, except for vehicles used for national defense purposes, vehicles of disabled persons, and vehicles used for less than 5 years. For motorcycles and mopeds with a cylinder capacity of less than 175 cm3, the Ministry of Transport will, based on actual conditions, research and propose a plan for the next phase (post-2020) for motorcycles of this type and ordinary mopeds.
According to the Draft Decision, "emission standard level refers to the maximum allowable limits of pollutant concentration in emissions permitted to be released into the environment by vehicles". The Draft Decision mandates that motorcycles with a cylinder capacity of 175 cm3, as stipulated in Article 2, must have a valid certificate and sticker certifying that they meet emission standards when participating in traffic.

Revamping Old Regulations
Regulations on technical safety control and environmental protection for motor vehicles in general, and emission control for motorcycles and mopeds in particular, are not new. However, due to the lack of effective inspection, control, and handling mechanisms, the regulations have almost remained on paper. To be specific: this content is stipulated in Article 53 of the Road Traffic Law 2008 on "Conditions for participating in traffic of motor vehicles", which states: "Two-wheeled motorcycles, three-wheeled motorcycles, and mopeds of the right type are allowed to participate in traffic must meet the standards on quality, technical safety, and environmental protection"; at point I) it is stipulated: "Must be equipped with a silencer, smoke reducer, and other devices ensuring emissions and noise meet environmental standards." Articles 74 and 102 of the Environmental Protection Law 2014 also mention this content.
According to the plan outlined in the Draft Proposal of the Government of Vietnam attached, during the period from 2016 – 2018, the Ministry of Transport will soon supplement the Government's Decree stipulating sanctions for administrative violations by users of motorcycles and mopeds who violate emission inspection regulations. Additionally, standards on levels, methods, and equipment for testing motorcycle and moped emissions serving the inspection will also be promptly amended and supplemented.
