Regarding this issue, LawNet would like to answer as follows:

1. Forms of feedback and recommendations on traffic administrative regulations in Vietnam

According to Clause 1, Article 6 of Circular 18/2022/TT-BGTVT, the forms of feedback and recommendations on traffic administrative regulations include:

- Reflecting and proposing in writing;

- Reflecting and making recommendations by phone;

- Reflecting and proposing through the opinion form;

- Directing feedback and recommendations;

- Data messages are sent via email to the receiving agency (email address: phananhkiennghi.tthc@mt.gov.vn); Portal of the Ministry of Transport (access address: https://www.mt.gov.vn); Public Service Portal and electronic one-stop information system of the Ministry of Transport (access address: https:/dichvucong.mt.gov.vn, section Reflections and recommendations); or the National Public Service Portal (access address: https:/dichvucong.gov.vn, section Reflections and recommendations).

2. Requirements for forms of feedback and recommendations on traffic administrative regulations in Vietnam

Specifically, in Clauses 2, 3, 4 and 5, Article 6 of Circular 18/2022/TT-BGTVT, the requirements for the form of feedback and recommendations on traffic administrative regulations are specified as follows:

2.1. Requirements for written feedback and recommendations

- Individuals and organizations should send their written feedback and recommendations to the following addresses:

+ Sending it directly at the Archives - Archives Office of the Office of the Ministry of Transport, No. 80 Tran Hung Dao, Hanoi; or

+ Sending via the postal system to the Ministry of Transport at No. 80 Tran Hung Dao, Hanoi; or

+ Sending via internet to the "Suggestions" section on the website of the Ministry of Transport (access address: https://www.mt.gov.vn), feedback and recommendations section on the Public Service Portal and electronic one-stop information system of the Ministry of Transport (access address: https:/dichvucong.mt.gov.vn); or sending an email to the address: phananhkiennghi.tthc@mt.gov.vn to the receiving agency which is the "Administrative Procedures Control Department" under the Office of the Ministry of Transport. (hereinafter referred to as the Administrative Procedures Control Department).

- Using Vietnamese language, Vietnamese character code Unicode TCVN 6909: 2001;

- Clearly stating the contents of feedback and recommendations;

- Specifying the name, address, phone number (or mailing address when needing to be contacted) of the individual or organization giving feedback or recommendations.

2.2. Requests for complaints and suggestions by phone in Vietnam

- Individuals and organizations may make complaints and petitions by phone via the hotline number 024.32151184 (in case of complaints or petitions from abroad, call 0084.2432151184) of the Administrative Procedures Control Department under the Office of the Ministry of Transport;

- Using Vietnamese language;

- Clearly presenting the contents of the feedback and recommendations;

- Notifying the name, address, phone number (or mailing address when needed) of the individual or organization that has feedback or recommendation.

2.3. Requirements for feedback and recommendations through the opinion form in Vietnam

This form is only used when agencies and units under the Ministry of Transport want to get opinions of individuals and organizations on specific administrative regulations. The submission of the opinion form can be done through one or more forms, such as:

- Sending a dispatch for comments;

- Collecting opinions through mass media;

- Sending data messages via the electronic information network (email, "Suggestions" column on the portal of the Ministry of Transport).

2.4. Requirements for reflecting petitions by data messages in Vietnam

Requirements for reporting petitions by means of data messages sent via email of the receiving agency, the portal of the Ministry of Transport, or the National Public Service Portal

- Complaints and petitions must be sent to the correct email address, the address to access the Portal of the Ministry of Transport or the address of the National Public Service Portal which has been publicly announced by the receiving agency. ;

- Using Vietnamese language; the font of the Vietnamese character code set (Vietnamese font Unicode) according to Vietnamese standards TCVN 6909:2001;

- Clearly stating the contents of feedback and recommendations;

- Specifying the name, address, phone number, email address or mailing address when contacting individuals or organizations with feedback or recommendations;

- Attaching files of appropriate format as required by the information system;

- Having an account on the National Public Service Portal (for organizations and individuals submitting complaints and petitions on the National Public Service Portal).
