Newly purchased vehicles without license plates in Vietnam: what you need to know to avoid being fined

In fact, many people drive around with the "vehicle waiting for plate" sign. However, the current traffic laws still do not have regulations allowing vehicles with the license plate "vehicle waiting for plate" to circulate. Therefore, it is necessary to note the following things about vehicles without license plates to not violate the law.

1. Newly purchased vehicles must be temporarily registered in order to be used in Vietnam

In Clause 3, Article 53 of the Law on Road Traffic 2008 stipulates:

Motor vehicles must be registered and affixed with a number plate issued by a competent state agency.

Therefore, people with vehicles who want to participate in traffic must register and attach license plates issued by competent state agencies. While waiting for vehicle registration, the vehicle owner is not allowed to operate the vehicle in traffic, except for the cases where the vehicle is temporarily registered under Article 12 of Circular 58/2020/TT-BCA (effective from August 1, 2020), specifically:

  • Vehicles that have not been registered or issued with official number plates must travel in traffic.
  • Automobiles registered abroad are permitted by competent authorities to enter Vietnam for tourism, conferences, fairs, exhibitions, physical training and sports;

  • Vehicles used at conferences hosted by the Party, State, and Government;

  •  

    Vehicles that carry out procedures to revoke registration certificates and license plates for re-export to the country or transfer in Vietnam and vehicles with decisions on transfer, sale, donation or donation.

Note:

  • The temporary vehicle registration certificate is valid for up to 30 days.

  •  

    Vehicles temporarily registered are allowed to participate in traffic according to the time limit, route, and range of activities stated in the temporary vehicle registration certificate.

2. Penalties for vehicles without license plates in Vietnam

When operating a vehicle without a license plate in traffic and without a temporary vehicle registration certificate as prescribed, road users will be fined with 02 errors as follows:

*** Penalties for lacking of Vehicle Registration Certificate:

For automobiles (including towed trailers or semi-trailers) and vehicles similar to vehicles, a fine of between VND 2,000,000 and 3,000,000 (point a, Clause 4, Article 16 of Decree 100/2019/ND-CP).

-For motorcycles, mopeds (including electric scooters), motorcycle-like vehicles and motorcycle-like vehicles: A fine ranging from VND 300,000 to VND 400,000 (Point a, Clause 2, Article 17 of Decree 100/2019/ND-CP).

-For tractors (including towed trailers): a fine of between VND 1,000,000 and 2,000,000 (point d, Clause 2, Article 19 of Decree 100/2019/ND-CP). In addition, the vehicle operator also has the vehicle confiscated (point d, Clause 3, Article 19 of Decree 100/2019/ND-CP).

*** Penalties for controlling vehicles without a license plate (for vehicles  required license plate):

- For vehicles (including towed trailers or semi-trailers) and vehicles similar to vehicles, a fine of between VND 2,000,000 and 3,000,000 (point b, Clause 4, Article 16 of Decree 100/2019/ND-CP).

- For motorcycles, mopeds (including electric scooters), motorcycles-like vehicles and motorcycle-like vehicles: A fine of between VND 300,000 and VND 400,000 (Point c, Clause 2, Article 17 of Decree 100/2019/ND-CP).

-For tractors (including towed trailers): a fine of between VND 1,000,000 and 2,000,000 (point DD, Clause 2, Article 19 of Decree 100/2019/ND-CP). In addition, vehicle drivers are also subject to additional sanctions: the right to use the driver's license (when operating a tractor); the certificate of training in legal knowledge on road traffic is deprived when operating a special-use motorcycle, from 1 to 3 months.

Thus, the driver of a newly purchased vehicle does not have a license plate, and a vehicle with a "vehicle waiting for plate" plate does not have a temporary vehicle registration certificate according to regulations, they will be fined according to the sum of the fines for the errors of not having the vehicle registration certificate and the error of the vehicle not having a number plate.
