Hanoi-Vietnam: A maximum fine of VND 2 million may be imposed for using mobile phones while operating vehicles under Decree 100/2019/ND-CP

On December 30, 2019, the Government of Vietnam issued Decree 100/2019/ND-CP regulating administrative penalties in the road and railway traffic sector, replacing Decree 46/2016/ND-CP.

 Comprehensive list of new penalties for automobiles and motorcycles from January 1, 2020

Decree 100/2019/ND-CP has increased the maximum penalties for traffic violations in Vietnam. Notably, the fines for using mobile phones while operating vehicles are increased, with a maximum fine of VND 2 million.

Point a Clause 4 Article 5 of Decree 100/2019/ND-CP stipulates a fine ranging from 1,000,000 VND to 2,000,000 VND may be imposed on operators of automobiles and similar vehicles committing any of the following violations:

a) Using a hand-held mobile phone while operating vehicles on the road;

Under the previous regulations in Decree 46/2016/ND-CP, operators of automobiles and similar vehicles committing this act may be fined from 600,000 VND to 800,000 VND.

For operators of motorcycles, mopeds (including electric motorcycles), and similar vehicles, Decree 100/2019/ND-CP stipulates that operators using umbrellas, mobile phones, and audio devices (except for hearing aids) while operating vehicles may be fined from 600,000 VND to 1,000,000 VND. (Previously, under Decree 46, the fine for this violation was only from 100,000 VND to 200,000 VND).

In addition, Decree 100/2019/ND-CP has also increased the maximum fine imposed on operators of motorcycles, mopeds (including electric motorcycles), and similar vehicles who do not comply with traffic signal lights. From January 1, 2020, operators of motorcycles, mopeds (including electric motorcycles), and similar vehicles that run red or yellow lights may be fined from 600,000 VND to 1,000,000 VND instead of the previous range of 300,000 VND to 400,000 VND.
