Hanoi-Vietnam: 17 violations subject to permanent confiscation of vehicles

Currently, according to the provisions of Decree 100/2019/ND-CP on administrative penalties in the road and railway traffic in Vietnam, effective from January 01, 2020, when committing the following 17 violations, the vehicle operator will have their vehicle permanently confiscated.

1. Operators of motorcycles, mopeds (including electric motorcycles), types of vehicles similar to motorcycles, and types of vehicles similar to mopeds who repeatedly or continuously engage in the following acts:

- Releasing both hands while driving; using feet to drive; driving while sitting to one side; lying on the seat while driving; changing drivers while the vehicle is in motion; turning around to drive or driving blindfolded.

- Performing zigzag movements or swerving on urban and non-urban roads.

- Driving on one wheel for two-wheeled vehicles, on two wheels for three-wheeled vehicles.

- Operating in groups of two or more vehicles exceeding the prescribed speed limit.

2. Operators of bicycles, electric bicycles, and other rudimentary vehicles who repeat or frequently commit the following acts:

- Performing zigzag movements or swerving; chasing each other on the road.

- Riding on one wheel for bicycles, electric bicycles; riding on two wheels for cyclo.

3. Operators of automobiles (including trailers or semi-semi-trailers being towed) and types of vehicles similar to automobiles who commit the following acts (excluding automobiles with more than 10 seats providing passenger transport services that exceed usage conditions but not exceeding 20 years from the year of manufacture, and automobiles with fewer than 10 seats providing passenger transport services):

- Operating vehicles that exceed the usage limits in traffic (for vehicles with prescribed usage limits).

- Operating unauthorized assembled or manufactured vehicles in traffic (including agricultural vehicles prohibited from traffic participation).

4. Operators of automobiles (including trailers or semi-semi-trailers being towed) and types of vehicles similar to automobiles who commit the following acts without the vehicle registration certificate or using the vehicle registration certificate not issued by the competent authority, incorrect vehicle frame number, engine number, or tampered the vehicle registration certificate and cannot prove the legal origin of the vehicle (documents on transferring vehicle ownership or legal documents of vehicle origin):

- Operating vehicles without the required vehicle registration certificate or using an expired vehicle registration certificate (including trailers and semi-trailers).

- Using unauthorized vehicle registration certificate, certificates, or inspection seals; using the vehicle registration certificate not matching the vehicle’s frame or engine number (including trailers and semi-trailers).

5. Operators of motorcycles, mopeds (including electric motorcycles), types of vehicles similar to motorcycles, and types of vehicles similar to mopeds operating unauthorized assembled or manufactured vehicles in traffic.

6. Operators of motorcycles, mopeds (including electric motorcycles), types of vehicles similar to motorcycles, and types of vehicles similar to mopeds who commit the following acts without the vehicle registration certificate or using the vehicle registration certificate not issued by the competent authority, incorrect vehicle frame number, engine number, or tampered the vehicle registration certificate, and cannot prove the legal origin of the vehicle (documents on transferring vehicle ownership or legal documents of vehicle origin):

- Operating vehicles without the required vehicle registration certificate or using expired vehicle registration certificate.

- Using a tampered vehicle registration certificate; using a vehicle registration certificate not matching the vehicle’s frame or engine number or not issued by the competent authority.

7. Operators of tractors (including semi-trailers being towed) and heavy-weight vehicles, manufactured, assembled, or modified illegally participating in traffic.

8. Operators of tractors (including semi-trailers being towed) and heavy-weight vehicles who commit the following acts without the vehicle registration certificate or using the vehicle registration certificate not issued by the competent authority, incorrect vehicle frame number, engine number, or tampered with the vehicle registration certificate (including trailers) and cannot prove the legal origin of the vehicle (documents on transferring vehicle ownership or legal documents of vehicle origin):

- Operating vehicles without the required vehicle registration certificate or using expired vehicle registration certificate (including trailers);

- Using unauthorized vehicle registration certificate, certificates, or inspection seals; using the vehicle registration certificate not matching the vehicle’s frame or engine number (including trailers).

9. Transportation business organizations, transport service providers using vehicles for transport business that do not meet the conditions of the registered business type (excluding automobiles with more than 10 seats providing passenger transport services that exceed usage conditions but not exceeding 20 years from the year of manufacture and automobiles with fewer than 10 seats providing passenger transport services).

10. Owners of motorcycles, mopeds, and types of vehicles similar to motorcycles; automobiles, tractors, heavy-weight vehicles, and types of vehicles similar to automobiles, modifying, welding, re-engraving the frame number or engine number or bringing vehicles with altered, welded, re-engraved frame or engine numbers to traffic.

11. Owners of automobiles, tractors, heavy-weight vehicles, and types of vehicles similar to automobiles bring vehicles that exceed the usage limits to traffic.

12. Owners of automobiles, tractors, heavy-weight vehicles, and types of vehicles similar to automobiles converting different types of automobiles into passenger vehicles.

13. Owners of motorcycles, mopeds and types of vehicles similar to motorcycles, automobiles, tractors, heavy-weight vehicles, and types of vehicles similar to automobiles committing the following acts without the vehicle registration certificate or using the vehicle registration certificate not issued by the competent authority, incorrect vehicle frame number, engine number, or tampered the vehicle registration certificate (including trailers and semi-trailers) and cannot prove the legal origin of the vehicle (documents on transferring vehicle ownership or legal documents of vehicle origin):

- Bringing vehicles without the vehicle registration certificate to traffic or with expired the vehicle registration certificate; bringing vehicles with temporary registration certificates to traffic beyond the permitted time, route, or area.

- Bringing vehicles with unauthorized the vehicle registration certificate, certificates, or tampered inspection seals to traffic; bringing vehicles with the vehicle registration certificate not matching the frame or engine number (including trailers and semi-trailers).

14. Unauthorized racing of bicycles, electric bicycles, cyclos, or animal-drawn vehicles (excluding animal-drawn vehicles on traffic roads).

15. Unauthorized racing of automobiles, motorcycles, mopeds, and electric motorcycles.

(As stipulated in point b, clause 4, Article 34, Decree 100/2019/ND-CP).

16. Operators of motorcycles, mopeds, types of vehicles similar to motorcycles, and types of vehicles similar to mopeds, automobiles, and types of vehicles similar to automobiles registered to operate in special economic-trade zones, international border gate economic zones repeating or frequently committing the following acts:

- Lack of the temporary import, and re-export vehicle declaration as per regulations.

- Lack of the required control emblem or using expired or unauthorized control emblems.

17. Bringing self-created vehicles to operate on railway tracks.
