According to Article 3 of Decree 56/2022/ND-CP, the organizational structure of the Ministry of Transport of Vietnam is regulated as follows:

1. The Department of Planning and Investment;

2. The Department of Finance;

3. The Department of Transport Infrastructure;

4. The Department of Legal Affairs;

5. The Department of Transport;

6. The Department of Science, Technology and Environment;

7. The Department of International Cooperation;

8. The Department of Organization and Personnel;

9. The Inspectorate;

10. The Office;

11. Vietnam Road Administration ;

12. Vietnam Expressway Administration.

13. The Vietnam Maritime Administration;

14. The Civil Aviation Authority of Vietnam;

15. The Vietnam Railway Administration;

16. The Vietnam Inland Waterway Administration;

17. The Vietnam Register;

18. Construction Investment Management Department.

19. The Technology and Information Center;

20. The Institute of Transport Strategy and Development;

21. The School of Transport Management Cadres;

22. The Transportation newspaper;

23. The Transportation magazine.

(From October 1, 2022, the Directorate for Roads of Vietnam will be separated into the Vietnam Road Administration and the Vietnam Expressway Administration)

Organizations specified in Clauses 1 to 18 are organizations that assist the Minister in performing the state management function; organizations specified in Clauses 19 to 23 are public non-business units serving the state management function of the ministry.

The Vietnam Maritime Administration, the Civil Aviation Administration of Vietnam, and the Vietnam Road Administration have their seals in the shape of the National Emblem.

The Vietnam Maritime Administration, the Civil Aviation Authority of Vietnam, and the Vietnam Inland Waterway Administration have Port Authorities in their organizational structures. The Airport Authority, the Maritime Port Authority, and the Inland Waterway Port Authority are administrative organizations equivalent to the Sub-Department of the Department under the ministry.

The Minister of Transport shall prescribe the functions, tasks, powers, and organizational structure of organizations under the Ministry; submit to the Prime Minister for promulgation a list of public non-business organizations under the ministry.

Tasks and powers of the Ministry of Transport regarding transport infrastructure of road, railway, inland waterway, seaway and airway in Vietnam

According to Clause 8 Article 2 of Decree 56/2022/ND-CP, task and powers of the Ministry of Transport regarding transport infrastructure of road, railway, inland waterway, seaway and airway in Vietnam:

- Guiding and inspecting the implementation of transport business conditions, transport development mechanisms and policies, and transport support services according to the Government's regulations;

- Formulating and promulgating national technical regulations in the field of transport exploitation;

- Announcing civil flight routes after being approved by the Prime Minister; publicizing road, railway, inland waterway, maritime, and public transport networks according to the provisions of law;

- Guiding the implementation of multimodal transport according to the Government's regulations;

- Organization of licensing of civil aviation activities; direct and inspect the implementation of regulations on coordination in the management of civil aviation activities;

- Detailed regulations on the management of activities at airports, airfields (excluding flight operations), seaports, inland ports, ports, inland waterways, railway stations, and the management of railway, inland waterway, and maritime transport routes.

Regarding traffic safety and security purposes in Vietnam, what responsibilities does the Ministry of Transport have?

- To assume the prime responsibility for, or coordinate with, the implementation of strategies, programs, plans and master plans on traffic safety assurance nationwide after being approved by the Government or the Prime Minister; guide and inspect the implementation of the provisions of the law on assurance of traffic safety by road, railway, inland waterway, maritime and civil aviation within the scope of functions and tasks of the ministry;

- To promulgate the Civil Aviation Safety and Security Program according to its competence; to detail the elaboration, assessment, and approval of the ship security plan, the seaport security plan, and the water zone and water zone security plan; to stipulate the issuance of certificates related to ship security and seaport security; to assume the prime responsibility for, or coordinate in, inspecting and providing information on the security and safety of civil aviation and navigation in accordance with law;

- To organize the investigation of aircraft incidents, accidents, and maritime accidents according to their competence and regulations of law;

- To preside over or cooperate in organizing search and rescue and response to oil spills in road, railway, inland waterway, maritime, and civil aviation traffic according to their competence.
