Regarding this issue, LawNet would like to answer as follows:

1. What is the administrative regulation on transportation?

According to Clause 1, Article 3 of Circular 18/2022/TT-BGTVT, administrative regulations on transportation are regulations on mechanisms, policies, and administrative procedures related to business activities and people's lives, promulgated by state agencies and competent persons according to the provisions of law and under the management of the Ministry of Transport.

2. Contents of reflections and recommendations on administrative regulations on transportation in Vietnam

Specifically, in Article 5 of Circular 18/2022/TT-BGTVT, with regard to administrative regulations on transport, organizations and individuals may reflect on and make recommendations on the following contents:

(1) Specific problems in the implementation of administrative regulations caused by acts of delay, difficulty, or failure to implement, and improper implementation of administrative regulations by agencies and units under the Ministry, as well as cadres and civil servants of agencies and units under the Ministry.

(2) The inconsistency with the reality of the administrative regulations on transportation.

(3) The inconsistency and inconsistency of administrative regulations on transportation.

(4) Administrative regulations on illegal transportation.

(5) Administrative regulations on transportation that are contrary to international treaties that Vietnam has signed or acceded to.

(6) Other issues related to administrative regulations on transportation.

(7) The plan to handle the complaints and recommendations specified in (1), (2), (3), (4), (5), (6), and (9).

(8) Initiative to issue new administrative regulations on transportation related to business activities and people's life.

(9) Reflect and make recommendations on administrative procedures in the field of transportation with the following contents:

- Administrative procedures have taken effect but have not been posted on the National Database of Administrative Procedures, the Portal, the Public Service Portal at the ministerial or provincial level, or have been posted but not fully and exactly as prescribed;

- Administrative procedures have expired or been abolished but are still publicly posted on the National Database of Administrative Procedures, the Portal, the Ministry-level Public Service Portal, and the Provincial-level Public Service Portal;

- Inconsistency between administrative procedures publicly posted on the National Database on Administrative Procedures and administrative procedures publicly available at the location where administrative procedures are settled, as well as between the National Database on Administrative Procedures and the Electronic Portal, Ministerial and Provincial Public Service Portal;

- The inconsistency between the administrative procedure to be resolved with the administrative procedure is publicized at the place where the administrative procedure is settled and posted on the National Database, the Portal, the Public Service Portal at ministerial and provincial levels;

- Administrative procedures also cause difficulties, obstacles and inadequacies, hindering production, business activities and people's lives.

3. Forms of feedback and recommendations on administrative regulations on transportation in Vietnam

Organizations and individuals may use the following forms to reflect on and make recommendations on administrative regulations on transportation in Vietnam:

- Reflecting and proposing in writing;

- Reflecting and making recommendations by phone;

- Reflecting and proposing through the opinion form;

- Directing feedback and recommendations;

- The data message is sent via email to the receiving agency (email address: phananhkiennghi.tthc@mt.gov.vn), the electronic portal of the Ministry of Transport (access address: : https://www.mt.gov.vn), Public service portal and electronic one-stop information system of the Ministry of Transport (access address: https:/dichvucong.mt.gov.vn, section Reflections and recommendations) or the National Public Service Portal (access address: https:/dichvucong.gov.vn, section Reflections and recommendations).
