1. What is visiting teaching?

Article 71 of the Education Law 2019 stipulates visiting teaching as follows:

- Visiting teaching is the act where educational institutions invite persons meeting criteria stipulated in Article 67 of the Education Law 2019 to conduct teaching.

Persons invited to conduct teaching by educational institutions are called visiting teachers or visiting lecturers.

- Visiting teachers and lecturers must perform duties as defined in Article 69 of the Education Law 2019. If being officials or public employees, visiting teachers and lecturers must first assure the fulfilment of tasks at their organisations.

- Encourage inviting domestic teachers and scientists, scientists who are overseas Vietnamese and foreigners to teach at educational institutions as visiting teachers or lecturers.

2. Duties of visiting teachers in Vietnam

Article 69 of the Education Law 2019 stipulates the duties of visiting teachers as follows:

- Educate and teach according to educational objectives and principles, implementing educational programmes with sufficiency and quality;

- Be exemplary in the fulfilment of civic duties, school charters and code of conduct of teachers.

- Maintain moral quality, prestige and honor of teachers; respecting learners' dignity, treating learners equally; and protecting legitimate rights and interests of learners.

- Study and practice continuously to improve moral quality, political qualification, professional qualification and knowledge, reforming teaching methods, and being good examples for learners.

3. Regulations on visiting lecturer contract in Vietnam

In Article 7 of Regulations on visiting lecturers in educational institutions, Circular 44/2011/TT-BGDDT (Regulations) promulgates regulations on visiting lecturer contracts as follows:

3.1. For visiting teachers who are cadres, civil servants, and public employees

- Visiting lecturer contract is a contract of service and work. The conclusion, performance, modification, and termination of the visiting lecturer contract shall comply with the provisions of Section 7 Chapter XV of the Civil Code 2015. The visiting lecturer's activities are not covered by the labor contract.

- In the contract of visiting lecturer, there must be a clause that the visiting teacher commits to completing the task at the place where he or she works.

3.2. For visiting teachers who are not cadres, civil servants, or public employees

- A "visiting contract" is a labor contract prescribed in the Labor Code for the activities mentioned in Points a, b, c, and d, Clause 1 and Article 2 of the Regulations. The conclusion, performance, and termination of the visiting lecturer contract, the complaint and denunciation, and the settlement of complaints and denunciations shall comply with the provisions of the labor law.

- A visiting lecture contract is a seasonal contract for the visiting lecture activities mentioned in Point DD, Clause 1, Article 2 of the Regulations. The conclusion, performance, modification, and termination of the visiting lecturer contract shall comply with the provisions of Section 7 of Chapter XVII of the Civil Code.

4. Limit of visiting teaching hours in Vietnam

In Article 6 of Circular 44/2011/TT-BGDDT, the limit of visiting hours is as follows:

The total number of visiting hours in a school year by a visiting teacher must not exceed the total norm of teaching hours and extra teaching hours as prescribed by law for teachers on the payroll performing the same duties.

5. Rights of visiting teachers in Vietnam

Article 9 of Circular 44/2011/TT-BGDDT stipulates the rights of visiting teachers as follows:

- To be entitled to wages, salaries and benefits as agreed in the visiting contract and in accordance with the law.

- To participate in professional activities, to foster pedagogical skills, to facilitate scientific research at visiting institutions, to be considered for awards, to be considered for recognition of standards and to be appointed the titles of Professor, Associate Professor as prescribed by law.

- To be provided and supported by the visiting institution with necessary documents, equipment and means of work;

- To be evaluated, graded and rewarded if there are achievements in education and training activities in accordance with law.
