Violation of enrollment regulations in Vietnam: Fine of up to 100 million VND

Decree 04/2021/ND-CP prescribing penalties for administrative violations against regulations on education in Vietnam, effective from March 10, 2021. Thus, this Decree stipulates fines of up to 100 million VND for enrollment violations.

Specifically, Decree 04/2021/ND-CP clearly states the penalties for violations of enrollment regulations as follows:

Enrollment notices and announcements of enrollment projects are incorrect or have incomplete information according to current law regulations

Enrollment notification is not given enough time according to current law provisions

Announcing enrollment quotas that exceed the number according to regulations on determining enrollment quotas

From 20,000,000 VND to 30,000,000 VND

Failure to properly follow the enrollment process according to current law

No input quality assurance threshold is announced for training sectors that have input quality assurance threshold regulations

From 30,000,000 VND to 40,000,000 VND

Performing enrollment not in accordance with the announced enrollment plan

Organizing enrollment for foreign majors, majors or educational programs without permission

From 40,000,000 VND to 60,000,000 VND

Violation of regulations on enrollment subjects

Enrolling the wrong subjects as prescribed in the admission regulations at the high school level

Depending on the number of incorrectly recruited learners, the fine will range from 1,000,000 VND to 10,000,000 VND.

Enrollment for intermediate and college level training for the wrong group of teachers

Depending on the number of incorrectly recruited learners, the fine will range from 5,000,000 VND to 30,000,000 VND.

Enrolling university-level training for the wrong subjects as specified in the admission regulations

Depending on the number of incorrectly recruited learners, the fine will range from 10,000,000 VND to 100,000,000 VND.

Enrollment for training at master's and doctoral levels is not for the subjects specified in the admission regulations

Depending on the number of incorrectly recruited learners, the fine will range from 20,000,000 VND to 100,000,000 VND.

Making false statements or altering documents in the admission application to gain admission, but not to the extent of being prosecuted for criminal liability

From 10,000,000 VND to 20,000,000 VND

Violation of regulations on enrollment quotas

Enrollment exceeds the target at the high school level

Depending on the rate of exceeding the target, the fine will range from 1,000,000 VND to 20,000,000 VND.

Enrollment for training at intermediate and college levels in the teacher sector exceeds the number according to regulations on determining enrollment quotas.

Depending on the overtaking rate, the fine will range from 2,000,000 VND to 40,000,000 VND.

Enrollment for university-level training exceeds the number according to regulations on determining enrollment quotas

Depending on the overtaking rate, the fine will range from 5,000,000 VND to 70,000,000 VND.

Enrollment for master's and doctoral degree training exceeds the number according to regulations on determining enrollment quotas

Depending on the overtaking rate, the fine will range from 10,000,000 VND to 80,000,000 VND.

Note: The penalty levels specified in this regulation apply to organizations. For individuals, the same administrative violation will be subject to a fine equal to ½ of the fine imposed on organizations.

In addition to the aforementioned fines, organizations and individuals who commit violations may also be subject to additional penalties and measures to remedy the consequences. Please refer to the details of additional penalty forms and measures to remedy the consequences for each specific violation in Decree 04/2021/ND-CP issued on January 22, 2021, replacing Decree 138/2013/ND-CP.
