1. What is visiting teaching?

According to Clause 1, Article 71 of Vietnam's Law on Education 2019, visiting teaching is the act where educational institutions invite persons meeting criteria, including:

- Having good morals, ideological and mental qualifications;

- Meeting professional standards of teaching position;

- Having skills of updating and upgrading professional capacity and knowledge; and

- Maintaining good health as required by the profession.

Persons invited to conduct teaching by educational institutions are called visiting teachers or visiting lecturers.

2. Standards for visiting teachers

Criteria for visiting lecturers and teachers specified in Article 5 of Vietnam's Circular 44/2011/TT-BGDDT include:

- For the teaching of subjects and topics prescribed in the program of preschool education, general education, professional secondary education, higher education, and continuing education to earn a degree in the national education system:

Visiting teachers must ensure the prescribed standards for being trained and fostered are met to improve their political, professional, and professional qualifications.

Visiting teachers who are teachers on the payroll or permanent teachers of a preschool or general education institution must meet the professional standards of teachers of the grade level at which they are visiting.

- For the teaching of topics not included in the curriculum of early childhood education, general education, secondary professional education, higher education, and continuing education to obtain a diploma in the national education system. people:

Visiting teachers must have the appropriate education and professional experience.

- For teaching foreign language and informatics refresher courses at continuing education centers, visiting teachers must have a college degree or higher.

- For activities of guiding, participating in grading, grading committees of projects and graduation theses; guiding, participating in the evaluation committee of master's and doctoral theses;

Visiting teachers must ensure the standards of being trained and fostered to improve their political, professional, and professional qualifications and follow the training regulations for master's and doctoral degrees.

- For activities of guiding experiments, practicing, and practicing under educational programs, visiting teachers must meet the requirements of experiment, practice, and practice of the subject, topic, or curriculum. education; and meeting the prescribed standards for staff doing laboratory work.

- For activities of participating in the formulation and development of training programs, compiling textbooks, teaching materials, or reference books by branch or major, visiting lecturers must ensure at least one of the following requirements: the following requirements:

+ Having a scientific work published in a scientific journal or in a collection of domestic and foreign scientific conferences;

+ There are monographs that have been published.

+ Having a scientific research topic that is accepted and accepted at the faculty level or equivalent or higher;

+ Having a technology transfer contract that has been accepted and liquidated.

3. Maximum teaching hours for visiting teachers

According to Article 6 of Vietnam's Circular 44/2011/TT-BGDDT, the time limit for lecturers and visiting teachers is as follows:

The total number of visiting hours in a school year of a visiting teacher must not exceed the total norm of teaching hours and extra teaching hours as prescribed by law for teachers on the payroll, permanent teachers performing the same duties. service.

4. Visiting teachers contract

The contract for visiting teachers according to Article 7 of Vietnam's Circular 44/2011/TT-BGDDT provides as follows:

- For visiting teachers who are cadres, civil servants and public employees:

+ Visiting lecturer contract is a contract of service and work. The conclusion, performance, modification and termination of the visiting lecturer contract shall comply with the provisions of Section 7 Chapter XVII of the Civil Code. Failure to perform labor contracts for visiting activities of cadres, civil servants and public employees.

+ In the contract of visiting lecturer, there must be a clause that the visiting teacher commits to ensure the completion of tasks in the place where he or she works.

- For visiting teachers who are not cadres, civil servants or public employees:

+ For the following activities, the visiting contract is a labor contract prescribed in the Labor Code:

++ Teaching subjects and modules prescribed in preschool, general, regular, professional intermediate and university education programs;

++ Teaching topics;

++ Guiding, participating in grading, project grading committee, graduation thesis; guiding and participating in the evaluation committee for master's and doctoral theses;

++ Guide experiments, practice, practice according to educational programs;

The conclusion, performance, termination of the visiting lecturer contract, the complaint and denunciation, the settlement of complaints and denunciations shall comply with the provisions of the labor law.

+ For visiting lecturers participating in the formulation and development of training programs, compiling textbooks, teaching materials and reference books, the visiting lecturer contract is a seasonal contract.

The conclusion, performance, modification and termination of the visiting lecturer contract comply with the provisions of Section 7 Chapter XVII of the Civil Code.
