Recently, the Government of Vietnam issued Decree 04/2021/ND-CP on administrative sanctions in the field of education, effective from March 10, 2021.
Vietnam: Heavy fines for violations of regulations on training association with foreign countries (Illustration)
According to Article 19 of Vietnam's Decree 04/2021/ND-CP, fines are imposed for violations against regulations on educational and training associations with foreign countries as follows:
(1) A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed for one of the following acts:
- Failure to guarantee one of the conditions for the implementation of educational and training linkages;
- Cheating to get approval from the competent authority to conduct educational and training links.
(2) A fine ranging from VND 40,000,000 to VND 60,000,000 shall be imposed for organizing the teaching of a joint education or training program that does not conform to the contents approved by the competent authority.
(3) A fine ranging from VND 60,000,000 to VND 80,000,000 shall be imposed for linking education or training when the time limit specified in the decision on approval, extension or adjustment of association has expired but cannot be extended or adjusted.
(4) A fine ranging from VND 80,000,000 to VND 100,000,000 shall be imposed for one of the following acts:
- Education or training links without written approval from competent authorities;
- To exercise autonomy in a training association when the prescribed conditions are not satisfied.
Currently, Vietnam's Decree 138/2013/ND-CP does not provide for administrative penalties for violations of regulations on educational and training linkages with foreign countries.
Thus, it can be seen that Vietnam's Decree 04/2021/ND-CP clearly stipulates the fine levels for violations of the implementation of educational and training linkages with foreign countries. As a result, beginning March 10, 2021, grassroots education institutions that violate regulations on educational and training association with foreign countries will face fines ranging from VND 30 million to VND 100 million.
In addition, educational institutions that commit the above violations will be suspended from educational and training association activities for 6 to 12 months. At the same time, force the transfer of eligible students who have been admitted to another educational institution that is eligible for permission to conduct educational activities, or cancel the matriculation decision, and pay interest on fees collected to learners if they do not transfer. for acts of educational association or training association without the written approval of a competent authority, or to exercise autonomously in association with training without satisfying the prescribed conditions.
