Vietnam: Fine of up to VND 100 million for violation against regulations on organization of TOEIC, IELTS exams

Below is the remarkable content specified in Vietnam's Decree 04/2021/ND-CP stipulating administrative sanctions in the field of education, replacing Decree 138/2013/ND-CP .

Vietnam: Fine of up to VND 100 million for violation against regulations on organization of TOEIC, IELST exams (Artwork).

Specifically, in Article 20 of Vietnam's Decree 04/2021/ND-CP, details fines for violations of regulations on joint organization of foreign language proficiency certification exams as follows:

Monetary fine:

(1) For one of the following acts, a fine ranging from VND 30,000,000 to VND 50,000,000 shall be imposed:

- Fail to ensure one of the conditions for the joint organization of foreign language proficiency certification exams;

- Cheat to get approval from competent authorities to organize the organization of foreign language proficiency certification exams.

(2) The fine ranging from VND 50,000,000 to VND 70,000,000 shall be imposed on acts of cooperating in organizing foreign language proficiency certification exams when the time limit specified in the approval decision has expired. The decision to renew the association may not be extended.

(3) A fine of VND 80,000,000 to VND 100,000,000 shall be imposed for issuing certificates in the absence of a decision of a competent authority approving the joint organization of the foreign language proficiency exam.

Note: The fines in this regulation apply to organizations. For individuals, for the same act of administrative violation, the fine level is equal to 12 of the fine level imposed on organizations.

Additional penalties

- Suspend the association's activities from 06 to 12 months for the violations specified in items (1) and (2) above;

- Confiscate the money collected from the commission of violations and add it to the state budget according to the provisions of law for the violations specified in items (2) and (3) above in case of violations. In this case, it is not possible to take remedial measures to return the collected amount.

Remedial measures

Forcibly return the collected money and bear all costs of organizing the return for violations specified in items (2) and (3) above.
