Vietnam: Fine of up to 10 million VND for insulting teachers, students

Decree 04/2021/ND-CP stipulating administrative sanctions in the field of education effective from March 10, 2021. In which, fine of up to 10 million VND shall be imposed for acts of insulting honor and dignity of teachers, students in Vietnam.

Specifically, according to the provisions of Articles 26 and 28 of Vietnam's Decree No. 04/2021/ND-CP, acts of offending honor and dignity, infringing upon the body of teachers and educational administrators in educational institutions Education and learners but not to the extent of criminal prosecution will be fined from VND 5,000,000 to VND 10,000,000.

Article 26. Infringing upon honor and dignity, infringing upon the body of teachers and educational administrators in educational institutions; Violating regulations on policies for teachers

1. A fine of between VND 5,000,000 and 10,000,000 shall be imposed for offending honor and dignity; physically infringing on teachers and educational administrators in educational institutions but not to the extent of criminal prosecution.

Article 28. Violations against regulations on student discipline; offending the honor, dignity, and body of learners; Violating regulations on policies for learners

1. A fine of between VND 5,000,000 and 10,000,000 shall be imposed for one of the following acts:

...

b) Infringing upon the honor and dignity of the student, infringing upon the student's body but not to the extent of criminal prosecution.

It can be seen that the fines for these acts are equal to those previously specified in Vietnam's Decree 138/2013/ND-CP.

Persons who commit acts of offending honor and dignity or physically infringing upon teachers, education administrators in educational institutions and learners must also take remedial measures to force a public apology to the offended person, unless the person whose honor and dignity is violated (or the student's legal representative who is a minor) requests not to publicly apologize (This is a newly added content in Decree 04/2021/ND-CP, previously Decree 138/2013/ND-CP did not provide for remedial measures for this behavior).

Note: The above fines apply to organizations. For individuals, for the same administrative violation, the fine level is only half of the fine level for organizations.

Vietnam's Decree 04/2021/ND-CP officially took effect on March 10, 2021, replacing Vietnam's Decree 138/2013/ND-CP.
