In the context that the epidemic is developing complicatedly and affecting many aspects of social life, greatly affecting the employment, life and income of workers, the Government of Vietnam has promulgated Resolution 116/NQ-CP implementing the policy to support employees affected by the Covid-19 epidemic from the Insurance Fund unemployment. So are teachers at public schools eligible for this support policy?

Are public school teachers still receiving support under Resolution 116? (Illustration)
According to the provisions of Resolution 116/NQ-CP of Vietnam, the beneficiaries of support policies from the unemployment insurance fund include:
(1) Employees participating in unemployment insurance as of September 30, 2021, excluding employees working at:
- State agencies
- Political organizations
- Social and political organizations
- People's armed units
- Public non-business units whose recurrent expenditures are guaranteed by the state budget.
(2) Employees stopped participating in unemployment insurance due to termination of their labor contracts or working contracts between January 1, 2020 and the end of September 30, 2021 have a period of premium payment. Unemployment insurance is reservedunder the provisions of the employment law of Vietnam, excluding monthly pensioners.
Therefore, teachers who are teaching at public schools may be subject to (1) of the policy to support workers in difficulty under Resolution 116.
As is known, public schools are public service units in the field of education. In Article 9 of Decree 60/2021/ND-CP of Vietnam, public non-business units are classified into 04 types, including:
- Public non-business units shall cover their own recurrent and investment expenditures.
- Public non-business units self-finance recurrent expenses.
- Public non-business units cover part of recurrent expenditures by themselves.
- Public non-business units with recurrent expenditures guaranteed by the State.
Compared with the provisions on the beneficiaries of support under Resolution 116/NQ-CP, only employees in the application with public services guaranteed by the State for recurrent expenditures are not eligible for support. Employees working in the remaining public non-business units will still receive support if they meet the conditions for paying unemployment insurance premiums as prescribed in Resolution 116.
Therefore, it can be seen that in the case of teachers (whether they are full-time employees or contracted teachers) who are teaching at public schools that are self-financed for recurrent and investment expenses; or self-financing recurrent expenses; or self-guarantee a part of recurrent expenditures if they are paying unemployment insurance premiums as of September 30, 2021, they will be supported according to Resolution 116 of Vietnam
The one-time support level in money, specifically as follows:
- Unemployment insurance premium payment period under 12 months: Support 1,800,000 VND/person.
- Unemployment insurance premium payment period from full 12 months to under 60 months: Support 2,100,000 VND/person.
- Period of payment of unemployment insurance from full 60 months to less than 84 months: Support 2,400,000 VND/person.
- Period of paying unemployment insurance from full 84 months to less than 108 months: Support 2,650,000 VND/person.
- Unemployment insurance premium payment period from full 108 months to less than 132 months: Support 2,900,000 VND/person.
- The period of paying unemployment insurance premium from 132 months or more: Support 3,300,000 VND/person.
