In this regard, Lawnet would like to answer as follows:

1. Responsibility to implement the Regulation in the management of educational activities in Vietnam

According to Articles 8, 9, 10 and 11, Decree 24/2021/ND-CP, the responsibility to implement the Regulation in the management of educational activities in Vietnam is as follows:

* Responsibilities and powers of the school council:

- In accordance with the law, approve admission plans, school educational plans, financial management plans, property, organizational structure, and personnel of educational institutions.

- Supervise the implementation of enrollment plans, educational activities of educational institutions according to the school's educational plan, the implementation of democratic regulations in managing educational activities of the educational institution

- Supervise the management and use of socialization resources for educational institutions, ensuring educational goals, publicity, transparency, and efficiency.

- Carry out other responsibilities and powers in accordance with the law on democratic implementation in state administrative agencies and public non-business units.

* Responsibilities and powers of the head of the educational institution:

- Organize managers, teachers, staff, and employees to participate in the development of enrollment plans, educational plans for the school, a financial management plan, educational institution property, organizational structure, and personnel; submit plans for approval to the School Council before organizing their implementation.

- Manage and use socialization resources to ensure the right purpose, fairness, publicity, and transparency; organize the implementation of enrollment plans, educational plans for the school, financial and property management plans, organizational structure, and personnel of educational institutions.

- Organize the assessment and quality accreditation of educational institutions according to regulations; organize cadres, teachers, staff, and employees to participate in assessing the quality of education and educational quality accreditation of educational institutions.

- Publicize the quality of education, conditions to ensure the quality of education, enrollment results, educational results, and results of evaluation and quality accreditation of educational institutions in accordance with the law.

- Carry out other responsibilities and powers in accordance with the law on democratic implementation in state administrative agencies and public non-business units.

* Responsibilities and powers of teachers, staff, and employees in educational institutions:

- Participate in developing and implementing enrollment plans, educational plans for the school, financial management plans, assets, organizational structure, and personnel of educational institutions according to functions and tasks assigned.

- Participate in the enrollment organization, educational activities, financial management, property, organizational structure, and personnel of educational institutions according to the functions and tasks assigned.

- Participate in supervising the enrollment organization, educational activities, financial management, property, organizational structure, and personnel of educational institutions in accordance with the law.

- Carry out other responsibilities and powers in accordance with the law on democratic implementation in state administrative agencies and public non-business units.

* Responsibilities of mass organizations, social organizations in educational institutions:

- Participate in developing enrollment plans, educational plans for the school, financial management plans, property, organizational structure, and personnel for educational institutions.

- Coordinate educational activities in accordance with the educational plan of the school of educational institutions, ensuring educational goals are met.

- Coordinate the use of socialization resources to organize educational activities and organize students to participate in social activities; serve the community to ensure the appropriate purpose, quality, and efficiency.

- Carry out other responsibilities and powers in accordance with the law on democratic implementation in state administrative agencies and public non-business units. 

2. Responsibility to give explanation regarding the management of educational activities in Vietnam

Responsibility in managing educational activities under Article 12 and Article 13 of Decree 24/2021/ND-CP as follows:

* Responsibilities of educational institutions:

The educational institution is responsible for explaining to society, students, management agencies, teachers, staff, and employees of the educational institution, in accordance with the law, the following contents:

- Objectives of education quality, enrollment plans, educational plans of the school, conditions to ensure the quality of education, the results of assessment, and quality accreditation of educational institutions.

- Admission activities, educational activities, financial management, assets, organizational structure, and personnel of educational institutions; ensuring the participation of students' families, organizations, and individuals in educational activities.

- Managing and using socialization resources to organize educational activities and organize students to participate in social activities and serve the community.

- Carrying out responsibilities for other contents in accordance with the law on the explanation of the performance of the state agency's assigned tasks and powers.

* Responsibility of the head of the educational institution:

- Determining the content and perform the explanation responsibility in accordance with Decree 24/2021/ND-CP and other provisions of the law to apply in educational institutions in accordance with the functions and tasks of educational institutions.

- Organizing the direction, urge and inspect managers, teachers, staff and employees in the educational institution to strictly implement regulations regarding the explanation and handling responsibility in case of violations of the provisions on the explanation responsibility in accordance with Decree 24/2021/ND-CP and other provisions of law.

- Performing responsibilities for other contents in accordance with the law on the explanation of the state agency in performing the assigned tasks and powers.
