Preschool and primary school teachers in extremely disadvantaged areas in Vietnam to be fully staffed to easure 02 sessions per day

Here is the notable content stipulated in Resolution 102/NQ-CP 2020 on staffing solutions for education and healthcare in Vietnam.

Preschool and primary school teachers in extremely disadvantaged areas in Vietnam to be fully staffed to easure 02 sessions per day

Resolution 102/NQ-CP clearly states that the arrangement of public employees must ensure the teacher-to-class ratio and student-to-class ratio. However, these ratios are not currently distinguished between urban, rural, delta, mountainous areas, and extremely disadvantaged areas. Thus, the Government of Vietnam requires:

For preschool and primary school levels in extremely disadvantaged areas, it is necessary to ensure sufficient staffing for teachers to teach 02 sessions/day according to regulations;

Moreover, the Resolution also states:

- Public educational institutions partially covering their own recurrent expenditures are allowed to sign employment contracts  with teachers within the total number of employees receiving salaries from the operational income allocated by competent authorities. Additionally, the institution must increase allocations to the welfare fund to sufficiently address the policies for these contracted employees upon termination of the labor contract.

- Public educational institutions partially covering their own recurrent expenditures and public educational institutions funded by the state budget for recurrent expenditures can sign employment contracts (under 12 months) with teachers within the number of ordained public employees allocated to promptly replace teachers on maternity leave or retirement according to policies and to arrange teachers for the second session in a day (for educational institutions that teach 02 sessions/day).

- Competent authorities for recruitment of public employees must organize recruitment to replace the lacking number of teachers, ensuring the sufficient number of working staff as assigned by competent authorities. employment contracts utilizing specialized skills should not exceed 12 months for positions designated for teachers.

- The Ministry of Education and Training is to propose solutions for the implementation of private investment in the second session in a day for preschools and primary schools, to be presented to the Government of Vietnam in the third quarter of 2020.

- The Ministry of Education and Training is to review and amend the student-to-class ratios stipulated in the regulations of various educational levels and the teacher-to-class ratios to suit the implementation of new curricula, general education textbooks, and the actual conditions of each region, to be completed in the fourth quarter of 2020.

- Ministries, ministerial-level agencies, government agencies, and the People's Committees of centrally affiliated provinces and cities are to seriously implement staffing reductions in conjunction with reorganizing public service providers, restructuring, and evaluating the performance of the public employees in the education sector.

- The Ministry of Home Affairs is to study the labor contract mechanism for specialized positions determined to be public employees within public service providers and present it to the Government of Vietnam in March 2021.
