Article 2 of this Draft prescribes the use of teachers who have not met the required training standards as follows:
- Teachers who, in the 02 (two) consecutive years immediately preceding the year this Draft takes effect, have results classified as meeting professional standards or higher, or have been classified and evaluated as public employees at the level of fulfilling tasks or higher, and are in good health, shall continue to be assigned teaching duties until retirement in accordance with regulations.
- Teachers who, in the 02 (two) consecutive years immediately preceding the year this Draft takes effect, have results classified as not meeting professional standards and have one year classified and evaluated as public employees at the level of not fulfilling tasks, shall not be assigned teaching duties. They shall be arranged to participate in professional training to be re-assigned to other suitable job positions until retirement in accordance with regulations.
- Teachers who are not in good health, wish to retire, and meet the conditions stipulated by the Law on Social Insurance shall be allowed to retire in accordance with regulations.
Thus, if the contents of this Draft are approved, from the effective date of this Draft, any teacher who, in the 02 consecutive years immediately preceding the year this Draft takes effect, has results classified as not meeting professional standards and has one year classified and evaluated as a public employee at the level of not fulfilling tasks, shall not be assigned teaching duties, and will be arranged to participate in professional training to be re-assigned to other suitable job positions until retirement in accordance with regulations.
In addition to regulations on the use of teachers who have not met the required training standards, this Draft also details the use of educational institution management officials who have not met the required training standards. Specifically, educational institution management officials who, in the 02 consecutive years immediately preceding the year this Draft takes effect, have results classified as not meeting principal standards and have one year classified and evaluated as officials and public employees at the level of not fulfilling tasks, shall cease to hold school management positions and be assigned teaching duties or arranged to participate in professional training to be re-assigned to other suitable job positions.
