New regulations in teaching for primary school teachers in Vietnam

Effective from October 20, 2020, Circular 27/2020/TT-BGDDT and Circular 28/2020/TT-BGDDT, which stipulate the evaluation of primary school students and the Charter of Primary Schools, officially come into effect. These two documents set forth important matters regarding what primary school teachers are permitted or not permitted to do.

1. Homeroom teachers can only introduce but not appoint class monitors and vice monitors

According to Clause 2 Article 16 Circular 28/2020/TT-BGDDT, the organization of classes is regulated as follows:

- Each class has a class monitor and vice monitors.

- Students in the class are divided into groups, each group has a group leader and vice leader.

- Class monitors, vice monitors, group leaders, vice leaders are either self-nominated by students or introduced by the homeroom teacher, and are elected by the students in the class or group and rotate throughout the school year.

- The form of organizing a class is flexibly carried out to suit different subjects and actual conditions.

Current: At Article 17 Circular 41/2010/TT-BGDDT, it is stipulated:

Students are organized according to classes. Each class has a class monitor, one or two vice monitors elected by the class collective or appointed by the homeroom teacher rotating throughout the school year. Each class has no more than 35 students.

2. Teachers primarily evaluate students through verbal feedback

At point a Clause 1 Article 6 of Circular 27/2020/TT-BGDDT, it is regulated:

- Teachers use flexible and appropriate assessment methods, but mainly through verbal feedback to point out to students what is correct, what is incorrect and how to correct it;

- Teachers write comments in students' notebooks or learning products when necessary, having specific measures to assist promptly.

Current:

According to the regulation at Article 6 Circular 30/2014/TT-BGDDT amended by Clause 3 Article 1 Circular 22/2016/TT-BGDDT:

Teachers use verbal feedback to point out to students what is correct, what is incorrect and how to correct it; write comments in students' notebooks or learning products when necessary, having specific measures to assist promptly.

3. Teachers in Vietnam are allowed to grade test papers with 0 points

At point d Clause 1 Article 7 Circular 27/2020/TT-BGDDT, the regulation on grading test papers is as follows:

- Test papers are corrected, commented on, and graded by teachers on a scale of 10 points, without using decimal points and returned to the students.

- The scores of periodic tests are not used to compare one student with another.

- If the results of the final test in the first and second semesters are unusual compared to regular evaluations, teachers may propose that the school allow the students to retake the test to accurately assess their learning outcomes.

Current:

At Clause 4 Article 1 Circular 22/2016/TT-BGDDT, it is stipulated that test papers are corrected, commented on, and graded by teachers on a scale of 10 points, without giving 0 points or using decimal points, and are returned to the students.

4. Teachers in Vietnam are allowed to use mobile phones

At Clause 1 Article 31 Circular 28/2020/TT-BGDDT, it stipulates that teachers need to pay attention to their behavior and attire as follows:

- Do not distort educational content, teach incorrect knowledge

- Do not cheat in assessments, deliberately misrepresent students' educational outcomes;

- Do not force students to take extra classes for material gain;

- Do not skip classes, miss teaching sessions, or arbitrarily cut educational content;

- Do not insult the dignity, honor, infringe on the body of others; do not smoke; drink alcohol or beer; disrupt security and order.

Thus, Circular 28/2020/TT-BGDDT no longer prohibits teachers from using mobile phones.

Current:

At Clause 5 Article 38 Circular 41/2010/TT-BGDDT stipulates that among the behaviors teachers are not allowed to engage in are:

Drinking alcohol, smoking cigarettes while participating in school activities, using mobile phones while teaching in the classroom.

5. Teachers are not allowed to criticize students in front of the class, the whole school, or in meetings with parents in Vietnam

Specifically, at Clause 3 Article 38 Circular 28/2020/TT-BGDDT, it regulates student rewards and discipline, stipulating that students who have shortcomings in learning, training, and engaging in competitions, depending on the severity of the violation, may be subjected to the following disciplinary measures:

- Remind, support, and help the student directly to make progress;

- Notify parents to coordinate and help the student address the shortcomings.

Note: Teachers are not allowed to criticize students in front of the class, the whole school, or in meetings with parents.

Current:

According to Clause 2 Article 44 Circular 41/2010/TT-BGDDT, students with shortcomings during learning and training, depending on the severity of the violations, may be subjected to the following measures:

- Remind, criticize;

- Notify the family.

Thus, Circular 28/2020/TT-BGDDT has removed the provision allowing teachers to criticize students in front of the collective. Because, at this age, this form of punishment negatively impacts their learning spirit, causing a "fearful" mentality for students.
