Many teachers in Vietnam may not receive Tet bonuses in 2021

According to the Resolution No. 27/NQ-TW of the Party Central Committee of Vietnam, there will be a separate Tet bonus fund for teachers in 2021. However, due to the impact of the Covid-19 epidemic, the Tet bonus fund will be rescheduled to 2022 and it is likely that many teachers may not receive Tet bonuses in 2021.

Specifically, according to provisions of the Resolution No. 27/NQ-TW of the Party Central Committee of Vietnam in 2018, a new salary regime shall be applied for officials, public employees and armed forces in the entire political system of Vietnam from 2021. To achieve this goal, one of the important reform contents is to design a new salary structure including: Basic salary (accounting for about 70% of the total salary fund) and allowances (accounting for about 30% of the total salary fund). Concurrently, supplementing the bonus (bonus fund is about 10% of the total salary fund of the year, excluding allowances).

In the spirit of Resolution No. 27/NQ-TW, from 2021, agencies and units will pay bonuses to officials and public employees (including teachers at educational institutions) based on this bonus fund. However, due to the impact of the Covid-19 epidemic, the reform of the salary policy for officials, public employees and the armed forces under Resolution No. 27/NQ-TW will be postponed. Specifically, at the 13th Conference of the 12th Party Central Committee from October 05 to October 09, the Party Central Committee of Vietnam agreed with the recommendation of the Government's Party Personnel Committee on the time to implement the new salary regime from July 01, 2022 (instead of 2021 as before) for officials, public employees, armed forces and employees in enterprises according to Resolution No. 27/NQ-TW.

Thus, in 2021, there will be no Tet bonus fund for teachers due to the impact of the Covid-19 epidemic. However, the 2021 Tet bonus for teachers will depend on public service providers (schools) to decide on their own according to the regulations of each unit based on funding, revenue and working productivity of each teacher.

Specifically, the salary and bonus regime for Tet 2021, in addition to the cases where it is applied according to the provisions of the Labor Code 2019 of Vietnam, teachers are also applied under the Law on Public Employees 2010 of Vietnam. According to Article 104 of the Labor Code 2019 of Vietnam, a bonus means an amount of money, a piece of property or item that is provided by an employer for his/her employees on the basis of the business performance or the employees’ performance.

Concurrently, according to Clause 3 Article 12 of the Law on Public Employees 2010 of Vietnam, public employees have the right to enjoy monetary rewards and be considered for salary raise under law and regulations of public non-business units.

Based on the above regulations, it can be seen that there is no provision regarding the right to receive Tet bonuses of teachers. Therefore, it can be understood that public non-business units (schools) are not required to give Tet bonuses in 2021 to teachers and the Tet bonus in 2021 will be decided by the school itself based on capacity assessment, working efficiency and based on the school's funding and revenue.

Thus, according to the above analysis, it is likely that many teachers will not receive Tet bonuses in 2021 if the school's funding source does not have a surplus or deficit or the teacher's work productivity is not effective, especially when the situation of the Covid-19 epidemic in 2020 is complicated and affecting the economy as it is today.
