According to Official Dispatch 642, concerning the collection of tuition fees and other charges during the temporary break due to the Covid-19 pandemic, the Ho Chi Minh City Department of Education and Training provides the following opinion:
According to the provisions of Article 13, Chapter IV of Decree 86/2015/ND-CP: Tuition fees are collected periodically monthly; if students voluntarily agree, the school can collect once for the entire semester or school year. Specifically:
- For preschool education institutions, continuous education, regular training, and short-term training courses, tuition fees are collected based on the actual months studied.- For general education institutions, tuition fees are collected 9 months/year.- For higher education institutions, tuition fees are collected 10 months/year.
In cases where teaching and learning are organized according to credit policies, educational institutions may convert and collect tuition fees per credit; however, the total tuition fees collected per credit for the entire course must not exceed the regulated tuition fees for the course if collected by the school year.
Thus, in general, educational units are allowed to collect tuition fees and arising charges based on the actual months studied and not exceeding 9 months for general education institutions.
As for non-public educational institutions, there is a need to negotiate with parents regarding arising charges and must obtain the parents' agreement.
