Expulsion is the most severe form of discipline for students. Below are regulations on the application of the form of expulsion that students need to know in order to avoid in Vietnam.
*Case where students who are exp in Vietnam
In Vietnam, pursuant to point c, Clause 1, Article 9, Appendix to Regulations for student affairs in formal higher education programs enclosed with Circular 10/2016/TT-BGDĐT on forced expulsion on students:
- Students who continue to breach rules during the fixed-term suspension period, or commit violations for the first time which have extremely serious nature or level and cause adverse effects on their higher education establishments and society;
+ Trafficking, illegally transporting, concealing and seducing other persons to use drugs(1st violation);
+ Concealing, circulating, accessing, using depraved cultural products or participating in superstitious activities or illegal religious practices. (1st violation);
A competent authority may be requested to make its decision to impose a proper disciplinary action in accordance with laws.
+ Harboring and brokering prostitution (1st violation);
+ Contravening laws and serve jail sentences (1st violation);
+ Harboring, trafficking weapons, explosives and goods which are prohibited by laws (1st violation)
+ Exam, test instead, or ask to test, test instead; do instead, ask to make or copy essays, projects, graduation theses (2nd violation);
+ Inciting and involving other persons to illegally go on a demonstration, print propaganda leaflets or posters (2nd violation);
+ If these violations are serious, a competent authority may be requested to make its decision to impose a proper disciplinary action in accordance with laws. (3rd violation);
+ Fighting, organizing or participating in fighting organizations (3rd offense);
+ Drinking alcohol during class time; drunk, beer when going to class (4th offense);
+ Gambling in any form (4th offense);
+ Participating in demonstrations, mass gatherings, and lawsuits against the law (4th violation);
+ Participating in prostitution activities (4th offense).
*Regulations on expulsion in Vietnam
Clause 2, Article 9 Regulations for student affairs in formal higher education programs enclosed with Circular 10/2016/TT-BGDĐT stipulates:
A disciplinary action which is at least a warning must be recorded into student administration documentation and informed to student's families.
Where students are subject to fixed-term suspension or expulsion, higher education establishments must inform local authorities and student's families for their coordination in supervision and education of these students.
