3 cases requiring compensation for advanced training for teachers in Vietnam

This is a noteworthy provision stipulated in Decree 71/2020/ND-CP of the Government of Vietnam on the roadmap for upgrading the standard training qualifications of preschool, elementary, and middle school teachers.

Per Article 11 of Decree 71/2020/ND-CP, teachers who are sent for advanced training must compensate the training costs under the following circumstances:

- Case 1: Willfully discontinuing studies, abandoning jobs, or unilaterally terminating employment contracts during the training period;

- Case 2: Unable to obtain a graduation degree from the training institution, except in cases of force majeure with recognized objective reasons by competent authorities;

- Case 3: Completing the course and obtaining a graduation degree but quitting or unilaterally terminating employment contracts before fulfilling the committed service duration as stipulated in point b, clause 2, Article 10 of this Decree.

Regarding the compensation costs, the method of calculation is specified in Article 8 of Decree 101/2017/ND-CP. Specifically:

Firstly, compensation costs: Include tuition and all other expenses for the course, excluding salary and allowances (if any).

Secondly, the method of calculating compensation costs:

- For cases 1 and 2 mentioned above, officials and public employees must repay 100% of the compensation costs;- For case 3 mentioned above, the compensation cost is calculated using the following formula:

Where:

- S is the compensation cost;

- F is the total actual cost paid by the agency or unit for one person attending the course;

- T1 is the required service period after the course(s), calculated in whole months;

- T2 is the actual service period after the training, calculated in whole months.

However, each year of service by the teacher (excluding probationary period and service post-training) reduces the compensation cost by 1%. For female teachers or those from ethnic minorities, each year of service reduces the compensation cost by up to 1.5%.
