Enhancing the management and maintenance of rural road systems in localities

The strengthening of management and maintenance of road network

May 11, 2022, Directorate for Roads of Vietnam has promulgated the Official Dispatch No. 2628/TCDBVN-QLBTĐB dated May 11, 2022 guiding the strengthening of management and maintenance of local road network as follows:

- Based on the plan and national target program of the National Assembly, the Government and ministries and regulatory bodies on new rural development for the period of 2021-2025, such as the Resolution No. 25/2021/NQ-QH dated July 28, 2021 of the National Assembly, the Decision No. 263/QD-TTg dated February 22, 2022, the Decision No. 320/QD-TTg dated March 8, 2022, and the request of the People's Committee of centrally-affiliated cities and provinces to direct their departments, sectoral administrations and People's Committees of districts and communes to prepare specific plans and programs for implementation of these plans and programs; in which prioritize resources subject to criteria 2 in rural traffic. Difficulties that arise during the implementation of this Circular should be reported to competent authorities for consideration.

- Study the Department of Transport to preside over and cooperate with People's committees of districts and relevant agencies in reviewing management, maintenance and operation of local road network, assessing shortcomings and inadequacies in order to have solutions to ensure traffic safety and smoothness; concurrently, study and set up the Project on innovation of management, maintenance and operation on local road system to meet development requirements (if necessary)., If there is any difficulty in policies and laws, suggest competent authorities to deal with them during the implementation.

+ To attach importance to the consolidation of the contingent of officials engaged in the management and maintenance of local road systems; to regularly organize training and updating of new law provisions related to the management and maintenance of roads, especially the management and maintenance of rural road systems, for commune- and district-level officials; at the same time to step up the application of scientific and technical advances to the management and maintenance of roads in line with the local socio-economic characteristics and natural conditions.

Accordingly, Directorate for Roads of Vietnam requests for prioritizing the implementation of criteria of criterion 2 of rural traffic. Request the Department of Transport to cooperate with People's committees of districts in reviewing, managing and maintaining local road traffic systems, assessing and handling shortcomings in a timely manner To regularly organize training courses to raise knowledge about law and management of the road system, especially in rural areas.

Implementation of road maintenance

According to Article 126 of the Law on Construction 2014 (which is amended by Point a and Point d Clause 47 Article 1 of the Law on Construction dated 2020), maintenance of construction works is prescribed as follows:

- Requirements on maintenance of construction works are prescribed as follows:

+ Construction works and their items, when being put to use, must be maintained;

+ The maintenance process must be established and approved by the investor before the construction work or work item is brought into operation; in conformity with its use purpose, type and grade, construction work item and equipment to be constructed and installed in the work;

+ The maintenance must ensure safety for people, property and works.

- The works' owners or managers shall have to maintain the construction works, machinery and equipment.

- The maintenance of construction works and their equipment must comply with the maintenance plan and the approved maintenance process.

- Large-scale constructions, complicated constructions, and those that significantly affect the safety and community interests must undergo periodic assessment of the safety of the constructions during their operation.

- The Government shall detail the maintenance and periodical evaluation of safety of construction works in the course of their use and responsibility to announce expired construction works.

Accordingly, the maintenance of roads must be carried out according to the approved maintenance plan and procedures and subject to regular assessment of road safety.
