According to the provisions of the Law on Food Safety and Hygiene, the restaurant is classified as a food service business establishment. This is a conditional business line that requires a certificate of eligibility for food safety issued by a competent state agency and must be registered as a business household or enterprise according to regulations.

Register for establishment of a restaurant in Vietnam

There are two forms of business registration:

- Business household registration

- Enterprise registration (limited company, joint stock company ...)

Depending on the size of the restaurant as well as the current and future business orientation, restaurant owners need to choose the appropriate form of business registration.

In particular, the business household registration is carried out at the business registration office of the district where the business household is located.

For example: if you open a restaurant in District 1, Ho Chi Minh City, you need to submit a business household registration application to the Finance and Planning Department of District 1, HCMC.

Business registration individuals need to prepare a set of business household registration documents, including the following documents, and submit them to the business registration agency for settlement according to regulations:

- An application for business household registration;

- Legal papers of the individual, for the head of the household business, the household member registering the business household in case the household members register the business household;

- A copy of the minutes of the meeting of household members on the establishment of the business household in case members of the household register as a business household;

- A copy of the household member's authorization letter for one member to be the head of the household business, in case household members register as a household business.

Upon receipt of the application, the business registration authority shall hand over a receipt and issue a business household registration certificate to the household business within 03 working days from the date of receipt of a valid application.

In addition to business registration, a food service business establishment must register to meet all food safety and hygiene conditions in order to be granted a Certificate of Eligibility for Food Safety. The registration is done at the People's Committee of the district after being granted the Business Household Registration Certificate.

Application for a Certificate of Eligibility for Food Safety in Vietnam

To apply for a Certificate of eligibility for food safety for a restaurant, a business establishment needs to prepare a set of documents including the following documents:

- An application form for a Certificate of eligibility for food safety;

- A copy of the business registration certificate;

- An explanation of the material facilities, equipment, and tools to ensure food hygiene and safety conditions as prescribed by the competent state management agency;

- A health certificate of the establishment's owner and the person directly producing and trading food, issued by a district-level or higher-level medical facility;

- Certificate of training in the knowledge of food safety and hygiene of the establishment owner and the person directly producing and trading food according to the regulations of the Minister of industry management of Vietnam.

After the preparation is complete, the business establishment shall make 01 set of dossiers and send it to the competent authority for processing and issuance of the Certificate of Satisfaction of food safety conditions according to regulations.
