Some Notes on the Investigation and Survey of Start-Up Enterprises in Vietnam

According to Official Dispatch 1932/BTP-QLXLVPHC&TDTHPL, the Ministry of Justice of Vietnam requests relevant Departments and sectors to focus on aggregating, analyzing, and evaluating the activities of monitoring the implementation of the law (inspection, investigation, survey, seminar) for startup enterprises based on the following contents:

1 Support for enterprises during the establishment process
  • Solutions to promote the transition from individual business households to enterprises;
  • Application for registration and establishment of enterprises;
  • Processing time for business registration;
  • Costs of serving the registration and establishment of enterprises;
  • Licenses for conditional business lines;
  • Support and guidance from local authorities when organizations or individuals request registration and establishment of enterprises.
2 Support for enterprises to access and utilize capital sources
  • Allocation and distribution of state budget funds for enterprise development support activities;
  • Administrative procedures when borrowing from banks;
  • Support for loan interest rates, collateral for loans, credit guarantees for enterprises in the locality;
  • Transparency of procedures and conditions for loans;
  • Management and use of local enterprise support funds;
  • Costs and time for implementing capital-related administrative procedures;
  • Challenges, obstacles, and recommendations of enterprises when accessing capital.
3 Support for enterprises to access and utilize scientific and technical resources
  • Process and procedures for establishing intellectual property and industrial property rights of enterprises;
  • Management and use of local budget funds to encourage and promote scientific and technological research activities, initiatives, and technical improvements applied to enterprise production;
  • Review, amend, and supplement national technical standards and regulations and evaluation procedures for conformity, creating favorable conditions for the commercialization of enterprise products;
  • Management and use of the National Science and Technology Development Fund, the National Technology Innovation Fund, etc.;
  • Challenges, obstacles, and recommendations of enterprises when accessing scientific and technical resources.
4 Support for enterprises to access and utilize land resources
  • Dossiers, time, administrative procedures, and costs arising in the process of the State leasing or allocating land to enterprises;
  • Reduction of land rent, conversion costs when enterprises request;
  • Transparency of information to help enterprises access planning documents, land use plans, and infrastructure construction projects;
  • Mechanisms for site clearance and land recovery for enterprises;
  • Progress, main challenges, and obstacles for enterprises when implementing investment projects;
  • Specific activities from competent state agencies in solving challenges and obstacles for enterprises in land issues.
5 Legal support for enterprises
  • Summary and understanding of the legal support needs of enterprises in the locality;
  • Development and implementation of legal support programs for enterprises;
  • Participation of local departments, agencies, and branches in legal support for enterprises.

Additionally, the Ministry of Justice of Vietnam also directs departments and agencies to note related contents such as:

- Professional qualifications and attitude of officials when receiving and handling administrative procedures related to enterprises;

- Inspection and examination activities at the local level towards enterprises;

- Progress and quality of dispute resolution, complaints, and petitions by competent state agencies when enterprises require;

- The role of business associations in the area in supporting newly established enterprises and connecting the business community with state agencies.
