Responsibilities of parties in Vietnam participating in the national online procurement system

Circular 08/2022/TT-BKHDT stipulates the responsibilities of the parties in Vietnam participating in the national e-procurement system as follows:

1. Responsibilities of investors participating in the Vietnam's online procurement system

- Perform the responsibilities as prescribed in Clauses 1, 5, 8, 10 and 13 Article 74 of the Bidding Law 2013.

- Take responsibility before law for the accuracy and truthfulness of the information registered and uploaded to the System when logging in with your System's Participating Account in Vietnam.

- Check and confirm the posting of their information on the system in Vietnam.

- Manage and be responsible for delegating authority to professional accounts corresponding to their roles; manage the use of digital certificates on the system.

2. Responsibilities of the procuring entity participating in the Vietnam's online procurement system

- Perform the responsibilities as prescribed at Points a, b, c, d, e, k Clause 1 and Points a, b, c, dd, e, k Clause 2 Article 75 of the Bidding Law 2013.

- Upload to the Information System on foreign contractors winning bids in Vietnam according to Appendix 7 issued together with Circular 08/2022/TT-BKHDT, the posting shall comply with the User's Guide.

The information is simultaneously sent to the Bidding Management Department, the Ministry of Planning and Investment within 07 working days from the date of approval of the contractor selection results as prescribed at Point c, Clause 1, Article 128 of Decree 63/2014/ND-CP.

- For bidding packages organized for international bidding, the procuring entity must publish the information specified in Articles 13, 15, 16, 18 and 19 of Circular 08/2022/TT-BKHDT in Vietnamese and English.

- The bid solicitor shall be responsible for the consistency of the documents posted on the System in Vietnam with the approved documents.

In case of discrepancy between the documents posted on the System and the approved documents, the documents posted on the System will be the legal basis for implementation.

- Monitor and update the information posted on the system in Vietnam and the information that the system responds.

- Manage and be responsible for delegating authority to the Business Accounts corresponding to their roles; manage the use of digital certificates on the System.

3. Responsibilities of contractors participating in the Vietnam's online procurement system

- Register to join the System in Vietnam to be approved under the provisions of Article 7 of Circular 08/2022 before the bid closing time to ensure eligibility as prescribed at Point d, Clause 1, Article 5 of the Bidding Law 2013.

- Perform the responsibilities as prescribed in Clauses 1, 2, 3, 4 and 5, Article 77 of the Bidding Law 2013.

- Provide and publish information on bidding in Vietnam on the System, ensuring compliance with the provisions of Article 80 of the Bidding Law 2013 and Article 7 of Decree 63/2014/ND-CP.

- Manage accounts participating in the System, identification documents of registration numbers on the System.
