The Ministry of Planning and Investment has just issued Decision 40/QD-BKHĐT on announcing new administrative procedures, amending, supplementing, abolishing and canceling publicity in the field of investment with official development assistance capital. (ODA) and grants that are not part of official development assistance within the scope of management functions of MPI.

Accordingly, issued 04 new administrative procedures including:
- Adjusting investment policies for programs and projects funded by ODA or concessional loans;
- Adjustment of programs and projects funded by ODA or concessional loans;
- Adjustment of decision on implementation policy and decision on approval of technical assistance and non-project documents;
- Order and procedures for signing, amending, supplementing and extending international treaties on ODA loans and concessional loans.
In addition, canceling 07 administrative procedures including:
- Formulate and approve the master plan for the implementation of programs and projects funded by ODA, concessional loans and reciprocal capital (central level);
- To decide on investment policies for programs and projects within the competence of the heads of the governing bodies;
- Order and procedures for deciding the policy of receiving general budget support from the Ministry of Finance;
- Formulate, appraise and decide on investment in important national projects funded by ODA or concessional loans;
- Making and appraising investment decisions on programs and projects within the competence of the heads of the governing bodies;
- Formulate, appraise and decide on investment in an investment program or project under the authority of the head of the governing body (provincial level);
- Prepare, appraise, decide to approve technical assistance project documents, non-refundable ODA projects (provincial level).
In addition, Decision 40/QD-BKHDT also amends and supplements 14 administrative procedures, in which:
- There are 10 administrative procedures under the jurisdiction of the National Assembly, the Government and the Prime Minister, including:
+ Participating in regional programs and projects;
+ Order and procedures for deciding on the policy of receiving general budget support;
+ The order and procedures for deciding on the policy of receiving central budget support for the national target program approved by a competent authority;
+ Proposing programs and projects using ODA or concessional loans;
+ To decide on investment policies for national target programs and important national projects funded by ODA or concessional loans;
+ To decide on investment policies for public investment programs funded by ODA or concessional loans under the Government's competence;
+ To decide on investment policies for group A projects funded by ODA or concessional loans;
+ To decide on investment policies for programs and projects funded by ODA or concessional loans within the competence of the Prime Minister, except for group A projects;
+ Formulate, appraise and decide to invest in programs and projects funded by ODA or concessional loans within the competence of the Prime Minister;
+ The order and procedures for deciding on the policy of implementing technical assistance and non-project projects fall under the Prime Minister's authority.
- 04 administrative procedures under the authority of the governing body, including:
+ Formulate, appraise and decide on investment in an investment program or project funded by ODA or concessional loan within the competence of the head of the governing body;
+ Prepare, appraise, decide on approval of technical assistance and non-project documents;
+ To prepare and approve the master plan for the implementation of programs and projects funded by ODA, concessional loans and reciprocal capital;
+ Formulating and approving the implementation plan of programs and projects using ODA, concessional loans and reciprocal capital annually.
Note: The current total number of administrative procedures in the field of ODA is currently 18 (of which: 14 administrative procedures under the Prime Minister's authority to decide; 4 administrative procedures under the decision-making authority of the governing body; newly issued administrative procedures are 4). 4, the amended and supplemented administrative procedure is 14, the abolished administrative procedure is 7).
Decision 40/QD-BKHDT takes effect from January 14, 2022.
