Procedures and documents for registration of certification of eco-industrial parks in Vietnam

Accordingly, the procedures and dossiers for registration of certification of eco-industrial parks in Vietnam are prescribed as follows:

1. Application file for certification of eco-industrial park in Vietnam

Investors implementing investment projects on construction and business of infrastructure of industrial parks shall make 06 sets of registration dossiers for certification of eco-industrial parks and send them to the Management Boards of industrial parks and economic zones.

- Regarding the application for registration for certification of an eco-industrial park, including:

+ Written registration for certification of eco-industrial park;

+ Evaluation and explanation of the ability to meet the criteria for identification of eco-industrial parks as prescribed in Article 37 of this Decree (enclosed with relevant documents);

2. Procedures for registration of certification of eco-industrial parks in Vietnam

Stage 1: Submit application for comments

Within 03 working days from the date of receipt of a complete dossier, the Management Board of the industrial park or economic zone shall send the dossier for consultation with the Ministry of Planning and Investment, the Ministry of Natural Resources and Environment, the Ministry of Science and Technology and the Ministry of Science and Technology. Technology, Ministry of Industry and Trade and Ministry of Construction.

Stage 2: Get opinions from agencies

Within 15 days from the date of receipt of a complete dossier, the agency that is consulted shall give opinions on meeting the criteria for identification of an eco-industrial park as prescribed in Article 37 of Decree No. 35/2022/ND-CP.

Stage 3: Organize the evaluation of the dossier and make a report

Within 40 days from the day on which the complete application is received, the Management Board of the industrial park or economic zone shall organize the evaluation of the dossier and make a report on the satisfaction of the criteria for identification of the eco-industrial park according to regulations. specified in Article 37 of this Decree.

During the assessment process, the management board of the industrial park or economic zone consults with the organization or unit that has the functions and tasks to satisfy the conditions for providing consultancy and assessment services. , certifying the efficient use of resources and cleaner production in accordance with the law.

Stage 4: Return results

- In case the assessment results are satisfactory:

Management boards of industrial parks and economic zones shall report to the People's Committee of the province to grant the Certificate of eco-industrial park to investors implementing investment projects on construction and business of infrastructure of industrial parks.

- In case of unsatisfactory assessment results:

Within 03 working days from the day on which the assessment results are available, the Management Board of the industrial park or economic zone is responsible for notifying the enterprise in writing and clearly stating the reason for the unsatisfactoriness.

Decree 35/2022/ND-CP takes effect from July 15, 2022 and replaces Decree 82/2018/ND-CP.
