New points on security and order conditions for conditional business lines in Vietnam

The Ministry of Public Security of Vietnam issued Circular No. 42/2017/TT-BCA on guidelines for a number of articles of Decree No. 96/2016/NĐ-CP of Vietnam’s Government on providing for security requirements applied to certain business lines, in which there are the following new notable regulations:

Firstly, branches and affiliated business establishments located outside the main business establishment's location may submit an application for Certificate of satisfaction of security and order conditions at the Police agency competent to manage the main business establishment or submit it to the police agency where the branch or affiliated business establishment operates.

Secondly, the Police agency with direct authority to manage the business establishment is responsible for guiding the business establishment to complete the contents of the plan to ensure security and order as prescribed in Clause 2 Article 8 of Decree No. 96/2016/NĐ-CP of Vietnam’s Government.

Thirdly, within 60 days from the date of issuance, renewal or re-issuance of the Certificate of satisfaction of security and order conditions for business establishments, the police agency shall notify in writing to the Department of Business clearly stating the content of the post-inspection and the time to carry out the post-inspection work.

Fourthly, the Police agency periodically inspects the business establishment no more than once a year, the inspection is notified in writing 5 working days in advance to the business establishment regarding the time, location, inspection content, and composition of the inspection team.

Fifthly, quarterly, the business establishment is responsible for reporting on the security and order situation of the business establishment according to form DK13 (issued together with Circular No. 42/2017/TT-BCA), to the directly managed Police agency.

Moreover, Circular No. 42/2017/TT-BCA also stipulates samples of pants, shirts, shoes, hats, shoulder straps, signs, lapel badges, badges attached to hats, signs of security service staff for the security service business.
