Guidance on forwarding some regulations on online bidding in Vietnam (Illustration)

According to Circular, Circular 08/2022/TT-BKHDT guides the transition of some regulations on online bidding in Vietnam as follows:

- For the approved bidding package, the contractor shall be selected online and made into online bidding documents in accordance with Circular 04/2017/TT-BKHDT, Circular 05/2020/TT-BKHDT:

+ In case the bidding package has posted online bidding documents to the System before August 1, 2022, the selection of contractors shall be conducted according to the posted online bidding documents and the provisions of the respective governing law.

In this case, the opening of bids, the posting of information in the process of selecting contractors on the System at http://muasamcong.mpi.gov.vn is done by a specialized digital certificate issued by the Center in Vietnam;

+ In case the bidding package has not established E-HSMT or has already prepared and approved online bidding documents but has not posted online bidding documents on the System, it must be amended and approved again according to the provisions of this Circular.

- For bidding packages in Vietnam that have been approved, the selection of contractors is not applied online:

+ In case the bidding package has posted the bidding dossier to the System before August 1, 2022, the selection of contractors shall comply with the issued bidding dossiers and the corresponding regulatory provisions;

+ In case the bidding package in Vietnam has not yet prepared the bidding dossier or has already prepared and approved the bidding dossier before August 1, 2022 but has not yet published the bidding dossier to the System, the bidding dossier must be amended and re-approved in accordance with Clause 8, Article 39 of Circular 08/2022/TT-BKHDT.
