1. Forms of providing information on bidding in Vietnam
According to Clause 1, Article 3 of Circular 06/2017/TT-BKHDT, the form of providing information on bidding is done on the Internet.
2. Time limit for providing information on bidding in Vietnam
The deadline for providing information on bidding according to Clause 1, Article 4 of Circular 06/2017/TT-BKHDT is as follows:
(1) The provision of bidding information as prescribed in Article 6 of Circular 06/2017/TT-BKHDT, except for the information specified in (2), (3) of this section, made within 07 working days from the date of issuance of the Decision or approval document issuing such information;
(2) The provision of information on the handling of violations of the law on bidding shall be made within 02 working days from the date on which the Decision on the handling of violations of the law on bidding is issued;
(3) Notice of invitation for prequalification, notice of invitation for expression of interest, notice of invitation to bid, notice of invitation to offer, notice of cancellation of bid, notice of extension, adjustment, and correction of posted information shall be carried out according to the progress of the contractor selection organization and must ensure the corresponding regulations related to the time in bidding according to the provisions of the law on bidding.
3. Regulations on provision of information on bidding in Vietnam
To provide information on bidding according to Articles 6 and 7 of Circular 06/2017/TT-BKHDT as follows:
* Information on bidding to serve the monitoring, supervision, and assessment of the implementation of bidding activities:
- Information on bidding to serve the monitoring, supervision, and assessment of the implementation of bidding activities, including:
+ Information about the project;
+ Contractor selection plan;
+ Notice inviting interest, notice inviting prequalification;
+ Notice of invitation to bid, notice of invitation to bid;
+ Short list;
+ Result of contractor selection;
+ Contract;
+ Recommendations;
+ Cancellation of bids;
+ Information on the handling of violations of the law on bidding;
+ Results of inspection and examination of bidding according to the approved inspection and periodic inspection plan;
+ Information about the winning foreign contractor in each project/contract package;
+ Other relevant information.
- The provision of detailed content for regulatory information is done in the form of webforms on the Network.
* Responsibility to provide information and how to do it:
- Responsibility to provide information:
+ The competent person is responsible for providing the information specified at Points k and n, Clause 1, Article 6 of Circular 06/2017/TT-BKHDT;
+ The investor for projects, the bid solicitor for regular procurement are responsible for providing the information specified at Points a to i, m, and n, Clause 1, Article 6 of Circular 06/2017/TT-BKHDT;
+ The bidding management unit is responsible for providing the information specified at Points 1 and n, Clause 1, Article 6 of Circular 06/2017/TT-BKHDT.
- Form of carrying out:
The provision of regulatory information is carried out according to instructions and webforms on the Network.
4. Principles of providing information on bidding in Vietnam
According to Article 2 of Circular 06/2017/TT-BKHDT, stipulating the principles of providing information and reporting on the implementation of bidding activities on an annual basis, as follows:
- Honesty, objectivity, accuracy, completeness, timeliness, and punctuality.
- Transparency.
- Information provided is systematic, linked, and in chronological order in accordance with the law on bidding.
- There is no overlap in reporting scope between ministries, ministerial-level agencies, government-attached agencies, other central agencies, or provincial-level People's Committees.
- For the annual report on the implementation of bidding activities, Ministries, ministerial-level agencies, government-attached agencies, other central agencies, and provincial-level People's Committees are responsible for the accuracy and consistency of report contents and reported data in the area, industry, or field of management.
- In case the information technology infrastructure fails to meet the requirements of reporting on the national bidding network system (hereinafter referred to as the network system) as prescribed in Article 3 of Circular 06/2017/TT-BKHDT;
Or due to confidentiality requirements in accordance with the law on confidentiality, the agency or unit responsible for reporting must send a written report.
