The draft Decree stipulating the conditions for business activities in sectors and professions requiring conditional investment in security and order has just been submitted by the Ministry of Public Security to the Government of Vietnam for consideration.
Currently, the regulations on security and order conditions for certain conditional investment and business sectors are being applied according to Decree 72/2009/ND-CP issued on September 3, 2009 (guided by Circular 33/2010/TT-BCA). This regulation specifically includes the conditional investment and business sectors that must comply with security and order conditions as follows:
- Manufacturing of seals for agencies, organizations, armed units; title seals, heading seals, signature seals, and other types of seals.
- Production and trading of industrial explosives and high-content Ammonium Nitrate (98.5% or higher) including the production, recycling, storage, purchase, and sale of industrial explosives and accessories, and high-content Ammonium Nitrate (98.5% or higher) for civilian purposes.
- Activities involving the production and trading of industrial explosives and high-content Ammonium Nitrate (98.5% or higher) including blasting services and sectors that use industrial explosives or high-content Ammonium Nitrate (98.5% or higher) during production and business processes.
- Production, trading, and repair of support tools, including manufacturing, assembling, purchasing, selling, and repairing support tools and accessories.
- Fireworks production, including production, business, export, import of fireworks and raw materials for fireworks production.
- Rental accommodations, including hotels, motels, and other forms of rental accommodation for overnight or hourly stays. Vietnamese citizens renting homes for living, working, or studying purposes are excluded from these conditions but must comply with the Law on Residence.
- Renting houses to foreign organizations and individuals for living or office use.
- Printing activities, including pre-press, printing, post-press processing, and color photocopying.
- Pawn services, including businesses offering loans with collateral.
- Karaoke services, including businesses offering singing activities via video tapes, discs, or other recording technologies.
- Dancing halls, including businesses offering dance activities at business establishments that meet legal requirements.
- Massage services, including physical therapy methods aimed at human health recovery and enhancement (excluding job centers for disabled people).
- Electronic gaming with prizes for foreigners.
- Casino operations.
- Debt collection services.
- Liquefied Petroleum Gas (LPG) trading, including gas trading agents, gas bottle retail stores, gas filling stations for bottles and vehicles, and gas supply stations.
- Production and trading of priority vehicle signal equipment, including production, trading, and import of flags, lights, and sirens for priority vehicles.
- Repair of hunting guns, including repair and replacement of accessories for hunting guns as authorized by competent State agencies.
In the "Draft Decree on conditions for business activities in conditional investment and business sectors regarding security and order" submitted by the Ministry of Public Security to the Government of Vietnam (to replace and unify documents Decree 72 and Decree 52), the Ministry of Public Security proposes to remove two sectors from security and order management:
- Renting houses to foreign organizations and individuals for living or office use;- Repair of hunting guns.
At the same time, the Draft also proposes to add five sectors to security and order management:
- Paintball gun business;- Betting business;- Cosmetic surgery services;- Business of information jamming and disrupting devices;- Business of military uniforms, equipment for the armed forces, military weapons, technical equipment, specialized military-use vehicles; components, parts, accessories, materials, and equipment specifically used for their manufacture.
