Details on the Classification of Construction Levels in the Management of Construction Investment Activities

The works and construction items are classified based on scale, type of structure, and importance to apply in the management of construction investment activities. The Ministry of Construction issued Circular 03/2016/TT-BXD providing detailed guidance on the classification of construction works.

- Applicable Subjects: This Circular applies to investors, project owners, owners, managers, users of works, domestic contractors, foreign contractors, state management agencies on construction, and other organizations and individuals related to construction investment activities within the territory of Vietnam.- Principles for Determining the Grade of Works- Scale of capacity, importance: applies to each work or technology line, a complex of works including: construction investment projects that may have one or several independent main works or main technology lines, a complex of main works that have interrelated relationships forming the overall scale and function of the project. Determined according to Appendix 1 of this Circular. In case the work is not listed in Appendix 1, the grade of the work is determined based on the structural scale.- Type and scale of structure: applies to each work in the construction investment project, determined according to Appendix 2 of this Circular.

Issued together with Circular 03/2016/TT-BXD are appendices specifying the grading of construction works. To be specific:

- Appendix 1 specifies details of construction works graded by capacity scale or importance, including the following types of works: civil works, industrial works, technical infrastructure (HTKT) works, traffic works, agricultural and rural development works.- Appendix 2 specifies details of construction works graded by structural scale.- Appendix 3 includes some examples to help contractors more easily determine the criteria for grading works (capacity scale or structural scale).

More details can be found in Circular 03/2016/TT-BXD which comes into effect on May 15, 2016, and replaces the regulations in Article 7, Appendix 1 of Circular 10/2013/TT-BXD and Clauses 4 and 6, Article 1 of Circular 09/2014/TT-BXD.
