Regarding this issue, LawNet would like to answer as follows:

1. What is computer-generated lottery?

According to Clause 1, Article 2 of Circular 36/2019/TT-BTC, computer-generated lottery means a form of lottery that is issued by terminal devices, landlines, mobile phones or the Internet and allows players to select one or several numbers in order to win prize according to the rules for each lottery product.

2. Conditions to become a lottery buyer in Vietnam

According to Clause 1, Article 4 of Circular 36/2019/TT-BTC, a lottery buyer shall:

- Be a Vietnamese citizen living in Vietnam or overseas, or a foreigner who has legally entered Vietnam;

- Be aged 18 years or older; and

- Have full legal capacity in accordance with Vietnamese law. In case of applied provisions of international treaties in which Vietnam is a member are different from the Vietnamese ones, the provisions of international treaties shall prevail.

3. Responsibilities and rights of lottery buyer in Vietnam

* Rights of lottery buyer in Vietnam

According to Clause 2, Article 4 of Circular 36/2019/TT-BTC, every lottery buyer has the right to:

- Receive the payout from the computer-generated lottery enterprise when he/she wins in accordance with the lottery game rules;

- Request the computer-generated lottery enterprise to protect the information of his/her win and the prize; and

 other lawful benefits as prescribed at the lottery game rules.

* Responsibilities lottery buyer in Vietnam

Every lottery buyer has the responsibility to:

- Comply with the lottery game rules and other relevant provisions in this Circular;

- When winning the prize, present the winning ticket(s) and other documents proving fulfillment of the conditions prescribed in clause 1 of this Article to receive the prizes; and

- Fulfill their tax obligation in accordance with law.

4. Lottery game rules in Vietnam

According to Clause 1, Article 6 of Circular 36/2019/TT-BTC, the computer-generated lottery enterprise shall establish the lottery game rules for each product of computer-generated lottery.

In particular, the lottery game rules shall consist of the following contents:

- Product name;

- Name of the enterprise issuing tickets

- Players and conditions for buying;

- Methods of participation;

- The value of one entry;

- Methods of verifying the result;

- The quantity and structure of prizes;

- The methods of ticket distribution;

- The schedule of drawing.

- Conditions to receive prizes for winning tickets

- Responsibility and rights of Players:

- Responsibility and rights of computer-generated lottery enterprises

- Recommendations regarding buyers’ self-control;
