1. What is ship repair?

According to Clause 5, Article 3 of Decree 111/2016/ND-CP, ship repairs refer to activities of restoration of a seagoing ship on a slipway, floating dock or shipyard after the ship is brought on the shore.

2. Conditions for ship repair service in Vietnam

2.1. General conditions

Specifically, in Article 4 of Decree 111/2016/ND-CP, the ship repair services must satisfy the following general conditions:

- Ship building, modification and repair facilities are enterprises which are established and operate according to laws.

- Ship building, modification and repair facilities shall comply with the conditions as prescribed in Decree 111/2016/ND-CP and other relevant law provisions.

2.2. Specific conditions

In addition to meeting the conditions specified in Section 2.1, a ship repair service business establishment must also ensure the conditions specified in Chapter III of Decree 111/2016/ND-CP (amended in Decree 147/2018/ND-CP), specifically as follows:

* Technical personnel, quality inspectors, ship repairers in Vietnam

- Ship repair facilities shall maintain a technical division and a quality inspection division separately to meet requirements for ship repairs. Each division shall encompass at least one person attaining university degree in shipbuilding, one person in ship engineering and one person attaining certificates of ship electricity from vocational schools or colleges.

- Technical personnel and quality inspectors shall have at least 12 months of experience in ship building, modification and repairs.

- Facilities that construct ships of metal body shall be staffed with at least three welders, one mechanic, one electrician and two painters according to national technical regulation on ship building and repair facilities. Welders shall have to attain certificates of specialties in accordance with national technical regulation on classification and construction of seagoing ships or equivalent.

- Facilities that construct ships of non-metal body shall be staffed with at least two ship’s hull fabricators, one mechanic, one electrician and one painter according to national technical regulation on ship building and repair facilities.

* Facilities and equipment in Vietnam

Ensure sufficiency of facilities and equipment according to national technical regulation on ship building and repair facilities;

* Occupational safety and hygiene, fire safety and environmental safety requirements in Vietnam

- Satisfy occupational safety and hygiene, fire safety and environmental safety requirements as prescribed by law.

- Ensure adequate quantity of means of collecting wastes discharged from ships when operating in seaports shall be adequate as prescribed in the International Convention for the Prevention of Pollution from Ships (MARPOL Convention) to which Vietnam is a signatory and other environmental safety requirements as prescribed by law.

* Quality management system

Ship repair facilities shall establish a quality management system including ship repair process according to ISO 9001 or equivalent within 12 months from the date on which they are eligible to operate, and shall maintain such system during their operation.

3. Application for recognition of eligibility for performing ship building, modification and repair services in Vietnam

According to Clause 2 of Decree 111/2016/ND-CP (amended in Decree 147/2018/ND-CP), the application for recognition of eligibility for performing ship building, modification and repair services shall include:

- Application form according to Form 01 in the Annex enclosed with Decree 111/2016/ND-CP;

Application for recognition of eligibility for performing ship building, modification and repair services

- Written description of material facilities required for production (Diagram of facilities, working offices, factories, warehouses, production facilities, measurement and inspection equipment);

- Quality handbook along with relevant materials and processes including environmental protection, labor safety, fire prevention and fighting documents approved by competent agencies according to laws;

- List of technical personnel and quality inspectors accompanied by copy of related diplomas, certificates.
