Decree 96/2016/ND-CP stipulating security and order (ANTT) conditions for certain conditional investment and business sectors came into effect on July 1, 2016.
Pawnshop services are among the business sectors that must ensure security and order conditions. This issue is specifically stipulated in Article 9 of Decree 96/2016/ND-CP. Specifically, the conditions include:
- The person responsible for security and order (ANTT) at the pawnshop business establishment must have had a permanent residence registration for at least 05 years in the commune, ward, or commune-level town where the business activities are registered;- In the 05 consecutive years preceding the business registration, the person responsible for ANTT must not have been subject to administrative sanctions by competent authorities for the following acts:
- Resisting law enforcement officers;- Disturbing public order;- Intentionally causing injury;- Engaging in usurious lending;- Gambling, organizing gambling, or providing gambling facilities;- Theft of property, fraud to appropriate property, or illegal possession of property.
With the above conditions, many businesses that have been and are operating pawnshop services will face significant challenges because the person primarily responsible for ANTT cannot meet the requirements, specifically the "05 years of permanent residence registration" condition as stipulated by Decree 96/2016/ND-CP.
