In the past week (June 28 - July 03, 2021), LawNet has updated important documents on officials, civil servants, public employees; Education; Social policy etc. specifically as follows:
1. Standards for participants in the public employee promotion exam specialized in Information and Communications
This is a content in the Circular No. 03/2021/TT-BTTTT on standards, conditions, contents, and forms of examination or consideration for promotion of professional titles of public employees specialized in Information and Communications, effective from August 15, 2021.
According to this Circular, public employees specialized in Information and Communications shall be nominated to compete for promotion when they fully meet the following criteria and conditions:
- Being nominated by a competent authority to take part in the competition for promotion of professional titles according to the provisions of Clause 1 Article 3 of the Circular No. 03/2021/TT-BTTTT.
- Holding the professional title of a public officer specialized in Information and Communications with a lower rank adjacent to the competition class.
- Being graded at the level of completing tasks well or higher in the working year adjacent to the year of submitting the application for promotion; have good political and moral qualities; not being within the disciplinary time limit, not being in the period of the implementation of regulations related to public employee discipline.
- Having the capacity, professional qualifications and expertise to take on a professional title of a higher rank adjacent to the one currently held; meet the requirements for diplomas, certificates and other requirements of the professional title standards to compete for promotion as prescribed.
- Satisfying the minimum working time requirements for holding adjacent lower-class professional titles as prescribed in Article 5 of the Circular No. 03/2021/TT-BTTTT.
2. Candidates may change can adjust wishes 3 times after having their high school graduation exam scores
This is a notable content in the Circular No. 16/2021/TT-BGDĐT amending Regulation on admission to undergraduate programs and early childhood education college degree programs attached to the Circular No. 09/2020/TT-BGDĐT.
Specifically, after having the results of the high school graduation exam, candidates can adjust their wishes to apply for admission three (03) times within the specified time, by online method.
According to the current provision, after high school graduation examination results are available, applicants may change their non-exam admission choices once within the given time limit online or at the exam application location.
Circular No. 16/2021/TT-BGDĐT takes effect from July 16, 2021.
3. Amending 04 cases of period which is not calculated for consideration of salary increase for officials, civil servants, public employees
Circular No. 03/2021/TT-BNV amending regimes on increasing regular salary, increasing salary before schedule and sửa đổi chế độ nâng bậc lương thường xuyên, nâng bậc lương trước thời hạn và the seniority allowance beyond the frame for officials, civil servants, public employees and employees, takes effect from August 15, 2021.
According to the Circular No. 03/2021/TT-BNV, there are 04 cases amended to provision on period which is not calculated for consideration of regular salary increase at Point c Clause 1 Article 2 of the Circular No. 08/2013/TT-BNV, including:
- The probationary period (including the case of receiving 100% of the salary of the civil servant rank, the professional title of the probationary public employee).
- Period of performing active military service, in which officials, civil servants, public employees and employees desert.
- Challenging period of officials, civil servants, public employees who are sentenced to prison but given suspended sentences; in case the challenging period is less than the extended period, the regular salary level increase is calculated according to the extended period.
- Time off from work until reaching retirement age according to current provisions of Vietnamese law.
03 cases as prescribed in the current Vietnamese law are still applicable.
4. Hỗ trợ tới 3,7 triệu đồng cho NLĐ nghỉ việc không lương vì Covid-19
The Government of Vietnam has issued Resolution No. 68/NQ-CP on certain policies to support employees and employers in difficulty due to the Covid-19 pandemic. In which, assistance to employees on suspension of employment contracts and unpaid leave are prescribed as following:
Employees will be entitled to a lump-sum support if they have worked for enterprises, cooperatives, public sector entities that cover their own recurrent expenditures or investment and recurrent expenditures, people-founded and private preschools, kindergartens, primary schools, junior high schools, high schools and vocational schools that temporarily cease operations at the request of competent authorities for the prevention and control of the COVID-19 pandemic and their period of suspension of employment contracts or unpaid leave is from 15 consecutive days or more from May 1, 2021 to the end of December 31, 2021, with a start date between May 1, 2021 and December 31, 2021;
Employees have contributed to compulsory social insurance up to the time of suspension of employment contracts or unpaid leave as follows:
- For 15 consecutive days or more but less than 1 month: VND 1,855,000 per person.
- For 1 month or more: VND 3,710,000 per person.
Resolution No. 68/NQ-CP issued on July 01, 2021.
