Salary classification of vocational education public employees from December 10, 2024; principles of developing self-consumption rooftop solar power from October 22, 2024; etc., are notable contents that will be covered in this bulletin.

1. Salary classification of vocational education public employees in Vietnam from December 10, 2024

On October 25, 2024, the Minister of Labor – War Invalids and Social Affairs of Vietnam promulgated Circular No. 10/2024/TT-BLDTBXH on amendments to Circular No. 07/2023/TT-BLDTBXH on professional codes and standards; salary classification and promotion of vocational education public employees. 

According to the Circular, public employees with salaries classified by the professional titles of vocational education public employees prescribed in Circular No. 07/2023/TT-BLDTBXH may apply the corresponding salary table enclosed with Decree No. 204/2004/ND-CP as follows: 

- Superior vocational education lecturer (grade I) - Code: V.09.02.01, may apply the salary coefficient of public employee type A3 group 1 (A3.1) from 6,20 to 8,00. 

- Principal vocational education lecturer (grade II) - Code: V.09.02.02, may apply the salary coefficient of public employee type A2 group 1 (A2.1) from 4,40 to 6,78. 

- Theoretical vocational education lecturer (grade III) - Code: V.09.02.03, may apply the salary coefficient of public employee type A1 from 2,34 to 4,98. 

- Practical vocational education lecturer (grade III) - Code: V.09.02.04, may apply the salary coefficient of public employee type A0 from 2,10 to 4,89. 

- Superior vocational education teacher (grade I) - Code: V.09.02.05, may apply the salary coefficient of public employee type A3 group 2 (A3.2) from 5,75 to 7,55. 

- Principal vocational education teacher (grade II) - Code: V.09.02.06, may apply the salary coefficient of public employee type A2 group 1 (A2.1) from 4,40 to 6,78. 

- Theoretical vocational education teacher (grade III) - Code: V.09.02.07, may apply the salary coefficient of public employee type A1 from 2,34 to 4,98. 

- Practical vocational education teacher (grade III) - Code: V.09.02.08, may apply the salary coefficient of public employee type A0 from 2,10 to 4,89. 

- Vocational education teacher (grade IV) - Code: V.09.02.09, may apply the salary coefficient of public employee type B from 1,86 to 4,06. 

The salary coefficients mentioned above shall be replaced and applied following guiding documents of competent authorities on new salary regulations for officials, public employees, and armed forces as the replacement for Decree No. 204/2004/ND-CP.

2. Vietnam’s principles of developing self-consumption rooftop solar power from October 22, 2024 

On October 22, 2024, the Government of Vietnam promulgated Decree No. 135/2024/ND-CP on regulations and policies encouraging the development of self-consumption rooftop solar power. 

According to the Decree, the principles of developing self-consumption rooftop solar power are as follows:  

- The development of self-consumption rooftop solar power shall ensure publicity, transparency, and equality among subjects prescribed in Decree No. 135/2024/ND-CP.

- The trading of excess electricity (if any) of self-consumption rooftop solar power shall comply with Decree No. 135/2024/ND-CP.

- The development capacity of self-consumption rooftop solar power systems connected with the national power system in each province shall conform with Decree No. 135/2024/ND-CP, excluding self-consumption rooftop solar power systems in districts and islands with power grids that are yet to be connected or linked with the national power system. 

- Construction works before installing self-consumption rooftop solar power systems shall ensure compliance with current investment, construction, land, environment, safety, and fire safety laws. The development of self-consumption rooftop solar power shall comply with electricity safety, investment, construction, environment, and fire safety laws.

- Organizations and individuals shall not use secondhand imported photovoltaic panels and power conversion equipment (from direct current to alternating current) during investment in the development of self-consumption rooftop solar power systems.

- Self-consumption rooftop solar power systems operating in assurance of the safety of the national power system shall be equal to other renewable power sources (solar power and wind power).

3. 6 banned acts in management of warehouses of material evidence, documents, and items in Vietnam from January 1, 2025 

On October 30, 2024, the Government of Vietnam promulgated Decree No. 142/2024/ND-CP on the management of warehouses of material evidence, documents, and items.

Banned acts in management of warehouses of material evidence, documents, and items: 

(1) Infringing on and destroying physical facilities, devices, and equipment for assurance of the safety and security of warehouses of material evidence, documents, and items. 

(2) Importing material evidence, documents, and items not regulated in Decree No. 142/2024/ND-CP.

(3) Bringing material evidence, documents, and items out of warehouses of material evidence, documents, and items without the permission of authorities or persons competent to order or decide the import of material evidence, documents, and items and authorities and persons competent to manage warehouses of material evidence, documents, and items. 

(4) Taking advantage of positions and powers to illegally consume, use, transfer, exchange, hide, add, subtract, modify, lose, damage, destroy, or remove seals and committing other acts that change the state of material evidence, documents, and items. 

(5) Using warehouses of material evidence, documents, and items for other purposes. 

(6) Allowing unauthorized persons or vehicles into warehouses of material evidence, documents, and items. 

4. Procedure for guarantee for off-plan housing in Vietnam from December 10, 2024  

On October 25, 2024, the Governor of the State Bank of Vietnam promulgated Circular No. 49/2024/TT-NHNN on amendments to Circular No. 11/2022/TT-NHNN on bank guarantee. 

According to the Circular, the procedure for guarantee for off-plan housing is as follows: 

- Based on the request of the investor or the counter-guarantor, the commercial bank or foreign bank branch shall consider, appraise, and decide to issue a guarantee to the investor;

- The guarantor and investor shall conclude the agreement on guarantee issuance in compliance with Article 26 of the Law on Real Estate Business 2023 and Clause 12 Article 3 and Clause 15 of Circular No. 11/2022/TT-NHNN;

- Based on the concluded agreement on guarantee issuance, the guarantor shall issue a written commitment to issue the letter of guarantee to the investor for the investor to send copies to the buyer after concluding the purchase or lease-purchase contract for housing; 

- After the conclusion of the purchase or lease-purchase contract for housing, which stipulates the financial obligations of the investor, the investor shall send the contract to the guarantor to request the guarantor to issue the letter of guarantee to the buyer; 

- The guarantor shall issue the letter of guarantee and send it to the investor for provision for the buyer according to the purchase or lease-purchase contract for housing, agreement on guarantee issuance, and written commitment to issue the letter of guarantee.
